I knew that I had it, paid for it on a monthly basis, and was glad to do so. I then was downsized and the trouble started. I sent in several requests to get the Payment Protection process rolling, actually I sent in three written requests, and had several phone calls and conference calls to try to find out why they never seemed to receive my applications. At the time I was downsized, I had a balance of  approx $1500. After a year of trying to get them to pay on their commitments, and all along paying the Payment Protection, I decided I was throwing good money after bad, and stopped paying. Of course their only reaction was to send me to a collections agent who tells me that my balance is now $3,000. I haven't seen a statement in a long time, isn't this a violation? I would love to know what is the best way of getting this resolved.

I was told to get a credit card and spend $300 on it and pay the minimum on it to show good payment history, so I did, I spent all but about $30 to $40 dollars, then I got my bill and saw that they had charged my card after my I charged on it a $fee of like $50 or so, it's like they waited till I got way up there to charge my card that so I would be over the limit, now I have a over the limit fee. All I want is a credit card to help get my credit back to good standing. My credit can't afford these problems cards like this one. I am very worried about this, and would like to know what I can do to avoid any problems with them, I opened the card up about 2 months ago.

I use my card for business and send them pmts of at least $500 per mo, mostly $1,000 . u would think I'm a valued customer. but it seems they are more interested in raping me. yes, I want to join.

Victims: get a photocopy of your check payment from your bank to prove that the Vampires had post your payment late on purpose to create more late and over limit fees! Take the Vampire to the Small Claims Court for the bank fails to post payments timely, and designates non-business days as payment due dates (i.e., Sundays and holidays), but does not receive payments on non-business days; for unfairly and unlawfully imposed and collected monthly fees for "fee-based" services which cardholders did not request or authorize, and/or prior to the end of the so-called "free trial period" for the product or service; for the unauthorized activation of these fee-based services may also trigger interest, late fees and over-limit fees and other charges as a result; for violations of the Truth-in-Lending Act (which requires certain disclosures) for cardholders who were enrolled in certain fee-based products (Payment Protection and/or Account Balance Coverage) at the time they opened their accounts; for excessive late fees to difficulties in reaching a zero balance (and thus being able to close an account) to problems with the bank reporting them to credit agencies.

Remember u only allowed to sue them with in a year or so. It'll cost u $22 or so for each case filing.

Please let us know how u win or lose the case so the next viewer will learn how to beat these blood sucking bats! If every consumer would take renegades like this to Small Claims Court, this kind of vampirism would soon fade away. 9 times out of 10 they will not show up due to the cost to have someone in court. The max u can sue is $5,000. But if u r asking more than the attorney fees (usually it's around $3,000 to $5,000) they may pay their attorney to show up and fight u back.

The flight I wanted was not available, according to the agent, although there were plenty of seats showing as available on the airline's web site, and I was following all of the other MilesOne award rules. I was told there was a different flight available at a time that really didn't fit for me very well, and it was going to require that I pay $200 out of my pocket and use my accumulated mileage. I did not book, deciding to look for alternatives. A few hours later I called back to book the flight. I was then told that the only flight available would cost $700 in addition to my mileage. The 30,000 miles I have is supposed to cover tickets that cost up to $500. The cost of the flight I wanted (according to the airline's own website) was under $500, but I'm told by the MilesOne agent that the only flight available is $1,200? This is NOT what I signed up for.

12/5/2003 12:44:15 PM / Gerald M* / gerald*@cogeco.ca / 519-***-**** / I live in Windsor, Ontario CA and 2 years ago I got this pre-approved form in the mail for CapitalOne tell me that if I sent them 75.00 to 200.00 that I could have a credit card that could help build up my so called bad credit rating and after 6 months I could request to raise the limit if the account has had no late payments or any defaults on it, Well my min payment each month is 10.00 but have been paying 20.00 and higher, a couple of times paid in full. Now 2 years later I still haven't received any limit raises and every time I call in 6 month apart they tell me that I have to wait for them to assess my usage and how payments have been made, Well like I said payments are always made through telephone banking 1 to 2 weeks early so what's up. I'm almost ready to cancel the card because as far as I can see my credit rating is most likely still the same and their get 26% of my 200.00 where I could take that 200.00 and put it in the bank and get paid 5 or 6 % on that money also I could buy something with that 200.00 and pay back my bank account not worry about loosing money to someone who is making 100s of dollars from my money. One more call and if I don't get a limit raise good bye card, don't need the credit that bad.

I have credit protection. I mailed CapitalOne all documentation to open a claim to the statement address. They apparently threw the corresponce away, never bothered to call and continued to bill my account. When I call to find out why the credit protection was not being applied they told me that was not the correspondence address. They did not bother to forward it to the correct department or give me a phone call. Now I am receiving collection notices. Cross Country Bank did the same thing which shows you how they feel about their customer service practices. I did not have this problem with Providian or Bank of America. They forwarded the information and took care the the matter professionally.

I contacted CapitalOne because I had payment protection insurance. they said everything would be taken care of but I later found out that wasn't so. as of now my account has gone from under $200(limit) to almost $700. they are trying to get me to pay $500 in payments and this settlement would stop all of my re-occurring charges. is there anything I can do?
11/29/2003 2:58:29 AM / road*@yahoo.com / what you people need to do is take CapitalOne to the Small Claims Court in your area. the max you can sue for is $5,000 ( in most states ). sue them for about $1,500. this should include all BS fees and for the hassle. 9 times out of 10 they will not show up due to the cost to have someone in court. and that 10th time a judge would understand your case. a buddy of mine did it to another card and also got $29 amount that it took to pay balance. also check with your local agency because some states have a mandatory 10 grace period on any credit relevant services. also the web master needs to find out the e-mail address of stock holder and put them up here for the world to see and e-mail.

U only allowed to sue them on certain time period, but the bad report they did to u (doesn't matter how much amount you disputed and they charged off) will stay over 7 years if u just complain and don't take action to fight back in time!!

I was going to put it on this new card so, I gave them the information and they put me on hold for third party confirmation. At that time, I told them I was also going to get confirmation from my husband. When I got back on the line, the operator was gone. No confirmation was made for the transaction. This disputed charge escalated from a $100 charge for a vacation, (we never got), to a almost $500. After much aggravation, I told them I would pay for the activation on the card since, they implied that is why they would not dropped their charge. I paid them $125. They still would not drop the charge, which is now $401, due to late fees and interest. The case number is 422709371190. I would very much like to settle this and remove it from our credit report. Her interest on the card is sky high and yes I have made contact with these people and they are very nasty and consistly calling her. We have accounts with both. They keep adding extra charges. Even after we talk to them & they tell us the extra charges will come off they never do. We were late a few times, but a payment was always made. We have also had them tell us they never received a payment but the check had cleared our bank. Come to find out that they had applied our payment to someone else account. They said it was our mistake not theirs. But we had the account number on the checks. They constantly call any day & any hour, after we have asked them not to call on certain days & after certain hours.

11/20/2003 7:01:30 AM/ CapitalOne Platinum Mastercard / I have just received a CapitalOne Platinum Mastercard and I have been reading the complaints on your site. However I have not come across a complaint specifically about the Platinum Mastercard by name. I was approved online and given an initial limit of $200 and when the card came in the mail my actual limit is $300. I was happy with this because I didn't want a high limit. The mail offer states I will 0% apr through my May 2004 billing period.  I am also wondering when I will get hit with the $59 annual fee. I now have a limit left of around $92 dollars to use on my card. I am afraid that if I use anymore then they will bill me with the annual fee and I will be over my limit and receive those fees. I am unsure of why the $59 annual fee was not taken out initially. I have had cards in the past that do that. It is like they want you to max it out and then they will add the fee to it in order to post you more fees (late and over limit) I just got the card so I have not received my first bill yet. I am thinking that I should cancel the card and pay what I owe before using it anymore. I am very afraid now of what is going to happen to my credit report. I already have some things on there from other cards ripping me off. When will I learn? Is there even a good credit card out there and how do you know?? I had a First Premier Bank Card and am letting you know they are just as bad if not worse.  They gave me an original limit of $250 and when they sent my card they had taken out $178 in fees which in turn left me with about $72 to use on my card. I had an issue with a company that had taken  charges out on my account that I did not okay. I called them the day I had spoken with this company and told them that I had given my account for identification purposes that day and that I was concerned they would charge on it and that I had never given them permission to. First Premier told me that the only thing I could do was dispute the charges if they appeared and that could take up to 3 months for my account to be fixed. The amount of money they took from me was just about the amount I had left for myself on the card. So there I was paying for a card that I essentially never used myself. I obviously cancelled that account immediately and I am still incurring late fees and over limit fees. I had starting sending them monthly payments to pay of my balance in full and ensure no bad credit reporting. Well every payment of $20 or $30 was pretty much going into thin air because every month they tacked on a late fee along with an over limit fee totaling $50 a month. Needless to say I told them that if they do not give me a final balance to pay and stop the late fees and overlimit fees that I am not paying them anymore. Mind you the late fees and over limit fees are applied at 12:01 am of the day you are late. There is no grace period at all. In fact I had mailed  a payment and apparently they didn't get it the day it was due and they called me the very next day harassing me about a payment. It was not even 24hrs late at that point. Anyways back to the original because I could go on and on about so much from this card like the nights I spent 5 hrs on the phone on hold and being passed from rep to rep trying to straighten out issues. I really think that if this platinum is a scam then I should close the account so can you please email me at DGrd*@aol.com and let me know if you have had any complaints with this card in particular because if they are gonna charge me anyways and screw me over I would like to use the last $100 that is left and at least get something out of it. I think it should not be legal for credit card companies to report bad credit unless fully investigated by and outside party to ensure that the claim is of the cardholders doing and not the company making up stories to scare people into paying whatever they feel like billing. I cannot emotionally deal with going through the nights of crying and feeling like I have been used abused and taken advantage of  (basically raped) by another company that has no feelings morals or care about human beings. DG*, CapitalOne have all kind of trick to deal with different level of card holder. My doctor told me he has CapitalOneCard of limit $5,000. Whatever CapitalOne do (they also have business in loan ' insurance and developing in Europe) they call all of their cards CapitalOneCard, so I started my http://www.Capital1Card.com  to fight these vampires (because they had already pre-registered the domain name of CapitalOneCard.com).

Then they changed their TV commercials into NO-HASSLECard  and of course they pre-registered the domain name of NOHASSLECard.com for next 10 years; but I figured out there is '-' between their 'NO' and 'HASSLE' , so I started my http://www.NO-HASSLECard.com .

Later I started my http://www.CapitalOneCard.ca and http://www.CapitalOneCard.us because we received the complaints from Europe, UK and Canada, one from India?? (We already have enough Europens hating US because of CapitalOneCard blood sucking over there, now India???)

Now CapitalOne changed their TV commercials into MILESOneCard. No problem this time, I learn their tricks already, guess who had started the http://www.MilesOneCard.com long time ago ?!!

When I called to have them remove the late fee and divide the payment, as specified in the payment, on the check and in document form that it was for two accounts. They simply said, You must make two payments. I never have had to make two payments before, as long as the check specified it was for two separate accounts. I told him that I recently took their representative up on their offer for a different type of card with a lower interest rate, and if he started to mess with me, I will not get that card. I told him to remove the $29 late fee and divide the payments according to what was specified on the check itself rendered for payment at least six days before it was due. I am thinking about checking with my attorney general's office to see if there are any other complaints with this company. For now, I think the brakes are on hold for the new card.

The exact wording on the annual fee terms was "no annual fee if your account is in good standing." The rate seemed good so I sent off an application. I soon received the card by mail. I never used it never even activated it. A couple of weeks after receiving the card I received a bill for a $60.00 annual fee. I thought I had misread the offer so I checked it. Then I couldn't understand how my account could have lost its good standing in only two weeks. I immediately returned the card with a request to cancel the account and an explanation of why. The following month I received another bill. This one for $89.00, the previous amount plus a $29.00 late fee. This time I took care of the matter by telephone. A thirty-day late payment appears on all 3 credit reports. I'm concerned that the late payment may affect my credit score.

When my husband was on layoff & back on, etc. I was put in a situation; I called to let them know that my husband was on layoff & they said they would take care of everything & to call back when he was back to work. His situation was layoff 3 weeks work 1. Over & Over. I didn't call them back until he was back on a steady basis. By now, my account was over $900; I had a $300 limit. Figure that one out. I now have the account down to $200+ The payment protection only paid $90+. Of course, leaving me with a HUGE payment that I really couldn't afford to pay. But, I did & they even charged me the $39.00 membership fee that was supposed to be NO fee membership. I didn't know that there was anything I could do. If you can help-Please let me know. Thank You!

My third month was April (tax season), I owed taxes that year and couldn't pay State until Federal Return came back so I paid full balance to visa each of the three months online with plenty of time required. The problem was the third month was marked one day later than I recall with no reason why the delay in posting waited. My rate was increased , was charged late fee which put me over limit my next purchase and charged a fee. With only $200 limit I made several payments and purchases in the same month and once records were juggled out of order so to create a huge mess. then I received a notice of increasing rate and to mark "NO" if refused agreement, and I did but didn't pay full balance before the deadline so my final payment was considered activity and default agreement assumed. I never got new card after expired so I put it out of mind but o small charge from auto pay that should have canceled but used this card as secondary payment source should have denied them but allowed the charge.

I have been trying to get this situation straightened out for a long time now and still it has been unresolved and has cost me to lose the home I was going to purchase, so I am very upset. I was told there was no record of myself in there database when they tried to pull my social security number as well as address.

It's a long and tragic story, but to make that short, all of our cards easily surpassed their credit limits. This was partly our own fault, but the interest rates and the late fees easily put us over the limit. Between the 5 cards, not one of them has a credit limit over $500. That was a year and a half ago that we we're over. On one card our limit was $300 and the balance now is over $1100. We couldn't get that down if we tried. Because of this and other financial woes, we are filing for bankruptcy. CapitalOne should be ashamed. We are suckers for falling for their shady practices, but when you have bad credit and no other creditor will give you any, you kind of have no choice. They don't help out, they hurt you. After a while of getting so many bogus fees and late charges it overwhelms you. If there is a lawsuit, I'm in. It's not right that they keep jacking up their interest rates and lying about when they received payments. I'm fed up & I've learned my lesson the hard way. When I start over CapitalOne will be a distant memory!!

It has been closed for over three yrs and in debt consolidation, but they keep adding on the fees and charges because they say this will happen until the account is paid off. Well I cant get it paid off if they keep adding and adding to the account. I have been paying on this for three yrs now and it should have been paid off as it started at only about $300 and now it is about three times that amount. They are as bad as Cross country as they do the same thing and I have them in the same debt program and it is the same story. When you close an account it should end there with the balance it had then not three or four times that amount. At this rate I wont ever get them paid as the late fees and over charges are four times the amount of the original amount.

I called and asked them to close my account but was informed that I would need to send a written request, I wanted to end the monthly charges because I was not using the card and decided that I did not want it anymore especially since I was not aware of the signup charge when I opened the account.   They did not close the account upon my request and it was eventually used but with all the fees or late charges, the account was never paid off.  It stayed on my credit report as an open account which continued to add charges. Only $75.00 was ever charged to the account but it now has a balance of $624.   I don't understand how it continued to add interest after it was closed 3/2000 and was reported as a charge off 9/2003.  I am willing to pay the amount that I charged but that won't remove this from my credit report

I'm writing to alert you to a problem I've had with a credit card issued by you. My problem concerns overall experience. I hope by bringing this to your attention, the problem will be addressed. This incident has made me extremely upset.

Here's what happened: I had a CapitalOne credit card account with a low credit limit. There is a discrepancy as to what my credit limit was.  CapitalOne has stated that my credit limit was $200 (which would mean I was only .94 over the credit limit), but CapitalOne has also stated it as being $201 (which would mean I was never over my credit limit).  I fell behind on a couple of payments due to work lay-offs.  However, I did resume payments.  I made numerous payments on my account--more than enough to pay for the principal balance as well as fees.  On numerous occasions my payments were not posted timely and I was penalized with late fees as well as continuous overlimit fees.  Additionally, the monthly payment requested was not sufficient to cover the fees that were charged (member fee, overlimit fee and late fee).  Once I realized this, I would add the various fees to my payment.  I noticed that although I made payments, the fees continued and the balance did not reduce None of the money I paid was ever applied to the principal amount charged.  Phone calls to "customer service" led to mounting frustration rather than solution.  Ultimately, I paid well over 3 times the principal amount charged.  I investigated further and discovered that the fees were being pyramided--which was illegal.  Once I discovered the illegal practice of pyramiding fees was taking place I ceased making any further payments.  When I requested the account closed, it was charged off shortly thereafter which revealed that the majority of the outstanding balance was fees and the principal balance remained untouched.  It was also reported to the credit reporting agencies that the account was closed at CapitalOne's request rather than mine.  I had attempted to get an itemized payment history from them, but was refused.  I have sought legal counsel regarding individual representation as well as inclusion in class action suits due to the mismanagement of my account and the illegal practice of pyramiding fees.

Anybody with similar experiences is welcome to contact me at js*@mychristianhost.com.  I am sure corroborating witnesses and evidence will be useful.

Here's what I want you to do: Zero out my balance and send letters to all three credit reporting agencies, with cc's to myself, directing them to update their records accordingly to remove any negative or detrimental ratings or comments regarding this account.

In the future, I will likely avoid doing business with CapitalOne .  And I definitely won't recommend CapitalOne to others.

9/11/2003 4:15:24 PM Pacific /  Jackie F* / jackief*@usadig.com /  406-***-****/ I have a Cross Country Bank credit card, which I listed with a debtscape to reduce my credit card debt, in fact I have several credit cards listed, but only one is not cooperating and that is Cross Country Bank, they would never accept the proposed offer and I continue to send in the monthly pymts to debtscape who distributes the pymts and Cross Country  debt is not going down it is going up because they continue to overlimit fees and late fees.  They use to harass me at work 3-5 times a day, I wrote them a letter to stop calling me at work, so now they send me a notice couple times a month that I am over the limit and min. pymt is 1127.00 and so on.  Back in Feb. my balance according to Cross Country  was 1541.68, now my balance is 2011.64, on a closed account that receives a monthly pymt. but keep charging me late and over limit fees.  I just want out from under this card.  Can you help or direct me. On Thursday Aug 14, I express overnighted a check drawn on a mortgage bank made out specifically to CapitalOne in the amount of $2,918 to pay off this card. This overnight envelope was signed for on August 15, as my due date was Aug 16th, I wanted to ensure that my credit stayed clean and the payment was applied. It is now Aug. 20 and the payment still has not been applied to my account. I have a signed receipt stating that CapitalOne received this express overnight package on the 15th, (see below) but Customer Service says there is no way they can check to see what was in the package, bulls*&^. "How do we know it was a check?" Come on, get real

For the other
CapitalOne card that I have (Carnival) I also sent another payment directly to them over a week ago, $992.on Wed, Aug 13th, and they are telling me they still have not received it.

I have spoke to two representatives about this issue and the only response I get is "well make another payment on line or phone it in for an addition $10". Chrissie Operator number 7682 was who I spoke to on 8/19.

What I find amazing about this is that the other 7 credit cards and two mortgages that I also sent checks to the same day have already been applied, only
CapitalOne is playing games and holding payment to ensure additional late fees. Sounds like CapitalOne is a huge scam.

I STRONGLY advise CARNIVAL CRUISE LINES line to really think twice before endorsing this company. I travel on Carnival quite frequently and this is giving me a sour taste in my mouth for both
CapitalOne and by affiliation, Carnival Cruise Line. I am a single Mom with two teenagers trying to get a head and games like this are uncalled for and truly deceptive in nature. You should be ashamed of yourselves.

I was told it was because my closing date was past and another month was beginning so I was charged a late fee. when I asked how much I should pay to catch  acct up to date I would be given an amount to pay that would get me current and I would pay that amt only to get another bill with yet another late fee. again I was told it was because my acct was paid on time but another closing date had past. the customer servic rep got very angry when i tried to find out the closing date. I did finally get the acct paid off but I was sent two more monthly statements with finance charges and pymt protection fees. I paid the first one (assuming it had something to do with the closing date but the next month when I was once again for these fees I cld them after unsuccessfully trying to get a live person to speak to. (tried every button given. finally called lost card rep and told her my problem and she said she would take care of the bal and i would not get another stmt. I am still waiting to see if that will be correct. I still have one card left and am working to get rid of it because I think they may be getting ready to charge another yearly fee to the bal.

That account was written off as a bad debt in 1994. My attorney at the time recommended to me that I NOT file bankruptcy and instead ignore the creditors and they would disappear from my credit report in 7 years. Most of them have done just that, but for CapitalOne. I contacted my attorney and he told me to contact them (which is impossible by phone) and follow up with a letter (which I did today) demanding an immediate accounting of the card. My car salesman even told me that what they were doing was illegal. Is this true? Around 1990, I had a daughter who was going thru the drugs, etc. route and was living with me. She left me totally so in debt I had no choice but to do something. That was when my attorney advised me against Bankruptcy. Actually, my car salesman said that was good advice. The financing agreement sent to me states that monthly payments more than 10 days late are subject to a $35 late fee. No problem! Last month, I called to inform them that I would be late with my monthly payment and would like to set up an arrangement to pay it in two installment. I arranged it so the entire payment would post before my next due date. The CSR explained to me the $35 late fee and I agreed to split that fee and pay equal portion with my two installments. On the date that my first installment was due, I called CapitalOne Auto Finance to confirm a wire payment for the agreed upon amount only to be informed that there was a $15 per day interest charge on the outstanding loan balance in addition to the monthly installment and late charge. By the time I will have made the 2 agreed upon installment, there will be an additional $420.00 in interest payments. This is ridiculous and I informed them that I will pay the $35 late fee, but I have no intention on paying a additional $420 because the payment was less than 30 days late. Can you help me. This is robbery!!

The one in Southfield (also within 2 miles from my home) recently closed. That apparently was enough of an -excuse-to have CapitalOne enforce a $200.00 reduction in my $1000.00 credit limit, AND to dictate that I send them the predicted over-the-limit amount by the August 1st payment. This occurred last month. The warned me that if I didn't pay the minimum due, the predicted finance charge and the (soon to be) over-the limit amount that I could expect a $30.00 fee for being over the limit and a $30.00 late charge for not satisfying the August 1st deadline. I paid $60.00, 3 months in a row, for NOT knowing that my payments were not taking me far enough below the $1000.00 limit to prevent another over-the-limit charge. My bill climbed so high I had a hard time coming up with the $320.00 it finally took to GET me below my $1000.00 limit. Here's the worst part...I had not used the card for 3 months and thought I had successfully kept the balance below $1000.00! They're got  they're NEWLY-ENFORCED over-the-limit dollars today and the August 1st normal payment, and the predicted service charge for August and an extra $50.00 because I'm afraid of their trickery. I just hope the didn't come up with another fancy way to charge me for MORE SERVICES UNRENDERED. I'll know next month, I guess. Very unbelievable to send them ($160,$160,$250) or $570.00 in 2 months when I haven't used their card in quite a while. They've really screwed up my ability to keep my other debtors happy. I have been trying got nine days to file a claim with payment protection. everytime, I would call they would give me the wrong information to file my claims. I even experienced on 7/22/03 where someone without my knowledge cancelled my payment protection insurance. I spent almost four hours on the telephone line speaking with payment protection trying to find out how and why someone was allowed to cancel my insurance. they could not give me a valid answer, instead they tried to say, it was cancelled by me the cardholder. they cancelled my payment protection insurance on the highest card balance without my knowledge. I have five credit cards through capital one bank and they all have credit protection insurance on them, why would I cancelled insurance on just one card? the reason, i pay payment protection insurance is to protect my self. I had no reason to contact the payment protection insurance prior to a couple of days ago in order to file a claim. they allowed someone to cancel my payment protection insurance in February of this year. they did not notify me of this fraulent activity on my account. they transferred my to be re-enrolled again in the payment protection plan. i should have never been dis-enrolled. I had to defend my self against  their mistakes. two of my credit card payments are due tomorrow and i still have not been able to file any claims. I spoke to someone again today and he agreed to sent me the claim forms through the mail. he told me to notify the credit card companies and that they would take care of any late fees and protect my credit. I have printed out all the information concerning the web information given to me by the payment protection insurance to prove that the filing claims information given to me by them is not legimate. I feel like I am being pushed off from filing an unemployment claim.

They are making me crazy, so crazy that I just ignore the bills. They can do whatever they want, obviously they already have to many people. Let them ruin my credit, it's ruined anyway right now. ( a 11-years old kid got credit card with $1,500 credit limit and his mom had to pay the charges when the 11-years old maxed the credit limit. 1 college boy killed himself in dormitory with spreading over his bed for $13,000 debts over 7 CapitalOneCard, 1 college girl moved back to her mother and still hung herself with spreading over statements over her room for $4,000 debt over 1 CapitalOneCard.)

We have just stumbled onto this website 6-23-03. It seems as though this lawsuit took place in 2000, but there are still people out there that have no clue about what is going on. So, someone please email me and let me know something. CapitalOne charged off my account, but yet the charge off is still revolving. My mother (who is now on disability), is being charged in the same manner. She is also being charged for using the card for getting cash; which she has never done. I received a statement with a balance of $650.00.We're in June, 2003 and I am disputing this but there are still charges and fees that keep occuring. This account should have been closed 7 months ago and the balance should have been zero in April!!!! CapitalOne is the worst bank I have ever dealt with. They are greedy liars. Anyone who has a CapitalOne account should cancel it right away or transfer the account to a more reliable bank. Get away from CapitalOne immediately!!!!

I need to know how to proceed if I need to at all. Just a little info on my situation. I am a 50 year old lady on SSI Disability. I had 2 accounts with CapitalOne. One for $7500. and another for $2500. I draw about $500 per month. I was keeping up the best I could on my accounts but major car repairs, food, cleaning products, gasoline for trips to doctors and other unforeseen problems soon raised my limit to where the my payments were less than the interest charged per month. In August of last year, 2002, I went with a Consumer Credit Agency, which I now regret but it seemed like a good idea at the time. They failed to get me a lower payment but said my account would be paid off sooner. They said they got CapOne down to 5% apr. From August to December I paid my account with Debticated on time but my account balances were going higher not lower. The interest was beginning to take over. I called CapitalOne, Debticated said this was up to me, to ask them to re-age my accounts. They would not and they were very rude about it. That is when I finally threw in the towel. Now my accounts have been turned over to a legal firm in Cleveland, Ohio who is bound and determined to take me to court. The attorney handling my case is as rude as the reps in the re-aging dept of CapOne who were the straw that broke this camel's back. This is my question: what can be done to me? What penalties can the court apply to me? I don't have the money now and I won't have it if they take me to court, so what do I do? I do not own a car, I live in subsidized housing, I am on Medicaid, I receive food stamps, I receive assistance on my electric and phone. What can they do to me? Other than going to jail I do not know what they expect from me. I have told them my situation but they are still hellbent on proceeding to file suit against me. Reading some of the complaints from other CapOne account holders I must say I agree with them. They have extremely rude customer reps and they are a very unfeeling organization when it comes to the misfortunes one encounters. I never had to ask for credit with CapitalOne. They sent me a notice saying I was pre-approved and just to check a box. I am sure if they did ask for an "employer" I did put down SSI Disability. But, I don't believe this ever came up. So, am I headed for jail or what? Any help you may give will be greatly appreciated. I have cut back and cut out everything possible just to exist from month to month. I have numerous physical problems and severe depression plus other problems. After the untimely passing of my mother, I had an emotional breakdown and have had a couple of relapses since. I am in chronic pain 24/7 365 days a year due to major back surgery and other related illnesses such as osteoarthritis. All of this with CapitalOne and now the legal firm is just about to cause my last nerve to snap. When I accepted CapitalOne's offers I really thought I would be able to take care of my financial obligations. I did not do this intending to run up my accounts and then default. I truly did not. They then went to a charge off. I finally recovered and received my settlement and wanted to pay off these accounts. I was unable to receive either a return phone call from the recovery service desk (James at ext: 405-61-39) nor from the Attorney's that are handling the case. This has caused us several problems in trying to obtain a car loan which we desperately need. I have called over the past two weeks. My husband has been trying to pay his off for over 3 months. This is an abuse, I have already been through enough, I have been trying to get on with my life and now this happens.
It is strange that the cards balance's got so high as neither my husband nor I were charging anything on these cards and we could not pay them off fast enough. For instants
my Husbands card which I had paid down to less than $150 had a final balance of $700. They say this is late fees but it seems like a great deal of money. I am very disappointed and feel like we are caught in a trap.

A two year harassment from month one and has not charged in years and still piling fees and calling house and even calling late at night. Hagman is a retired Banker who was a CEO at his last position in Beverly Hills so he understands they are breaking the consumer and credit laws and has told them so and they do not care and said so. He would make a terrific witness and help in a legal action. He also has documented their activities.

Adding on fees and not paying off the account even if you pay 100.00 or 75.00 dollars. If they give me a bad rating and I do lose my job and can't get one in the future or if my father or husband get heart attacks because of this, I will sue them for harassment, since my husband and I didn't know of this litigation beforehand and we have CapitalOne cards right now. If they continue on the path they are going, I may with others help put a ad in the newspaper warning people about them. It was fine, until I had a pay cut and my husband lost wages with the world like it is today, but being ripped off like we are is not right for any company, no matter who they are.

Over limit fees and late payment fees made it almost impossible for me to lessen the amount owed to them. I am now going through a divorce and just had a heart attack, thus it is even harder for me to deal with these people. I believe that they have their own collection department and this department will not negotiate any term of payment except full payment immediately.

She didn't live with me when she got the card and didn't live with me when the hassles started. Now she does live with me and I'm going through AMAZING MENTAL ANGUISH due to the collections practices of this company. When they call me at nine in the morning and I tell them that my roommate is sleeping, I'm told that I'm "full of crap" and that they will keep calling back until they reach her. Then I told them that I work midnights and was again told I'm full of crap. Then I started getting mad and I was swearing at the gentleman and he asked me if I talk to my mother with that mouth and when I replied no because my mother had died, he said that she probably died because of my mouth!!! Now this was the third time he'd called in 10 minutes and I wasn't being serious when I said my mother died but if I had or if he said this to someone who's mother had passed on, could you imagine what they would be feeling like right now??? I'm so disgusted and pissed right off at this company and I DON'T EVEN HAVE A CARD WITH THEM!!! What can I do??

I was promised no interest but that was a lie - I ended up paying double my limit to pay it off. the interest was so high I had to enroll into a debt consolidation just to get the rates lowered and that even was a killer

They are now saying that I owe them $1097.00. Where did this come from. CapitalOne is a ripe off. I was a high school student with no job when they sent me this card. CapitalOne has not only done this to me but they have also done this to my mother and many others of my family. Because of CapitalOne my credit has been ruined and it prevents my from making major purchases in my life like buying a home. This is a debt I did not create.

I owed about $4700.00, I am now at $5201.55 I would like to know where the $1000.00 (approx) went, that the insurance has paid them?
We have not used our card for over a year. And NEVER WILL AGAIN!!

I have a credit card with a 700.00 credit line it being almost paid off 123.00 never late, and as a mater of fact they sent me another credit card which I had declined, but they sent it anyway, with a 300.00 credit line. I saw the commercial for their platinum card and wanted to transfer the small CapitalOne balance over and my American Express Blue Card balance of 673.00 over because of the interest they are offering. Wow to my surprise I received a form letter stating that I was not qualified because of my balances owed to bank cards...what the hell is this about I have two cards, I am so mad I can spit nails but have decided to mail my complaints on to the CEO and some other people. I am in the very good position to post this information without blame, as I am involved with the Better Business Bureaus of America, and my sister is a consumer reported for a local affiliate of CBS. She has had bad experiences with these monsters I guess, hasn't everyone, I know they just closed a call center here in my area due to some problems. I would to join a class action suit, they have treated me so unfair. Its OK, I have heard that some top officials in their organization are in real trouble with some agencies....they (the top officials) will probably to the right thing and commit suicide or be bumped off by a pissed off customer, and gee if I were any of them I would not really be to quick to let people know who you work for. Kind of keep it to themselves when things go wrong or they have screwed up, sound like some of the ranking elected (by whom) officials...
