When that happened and I called them , they said That since I was a self imployed Mural Artist that the agreement was invalid, even though I had payed a monthly fee for that option for over a year. They never returned that portion of my payment and now since my house burned down I don't have much documentation. I have also defaulted on my card and they are sueing me. My card was payed off last April then my son borrowed it for a trip. He ran it up to 290. and was supposed to pay it off, they added a yearly fee that month which put it over the 300. limit and charged me 29. over the limit fee. Now one year later they say I owe them over $700.

Rebecca, whatever they do, they just need to do one thing, collect at least $1,000 from u or else they r losing money on your account because it cost them $1,000 to get a new blood like u! Sue the Vampire!!

John, u got the wrong idea about our web site, we r NOT CapitalOne  blood sucking evil card itself. We r the CapitalOne  victims group together to fight the vampire. CapitalOne  spend millions of money to promo their CapitalOne  blood sucking card, all they want is to make u call! To get your signature. CapitalOne  spend tons of money to get u, once when u r IN, they need to charge u at least $1,000 from u, or else they will consider they lose money on u. Usually their over-limit charges' late charges (read our web and u will see, doesn't matter when and how u pay their bill, u ALWAYS get the late charge!) r never collecting quick enough, so they will give u another 2 more of their CapitalOne  NO-HASSLE cards so they can charge u three times faster. 3.One viewer had complain about some services (collection department from CapitalOne , they even have a attorney with young voice, and he told people that his name is Mr. James, no last name, no first name, just 'Mr.James'.) called and gave 60% discount if he call their number to transfer the balance, so he dialed the number and enter his banking account, and next day, all his money was gone! CapitalOne  raised my interest rate after one late bill. I have been a loyal customer for 6 years, paying off several charges and doing frequent balance transfers. When I requested them to reduce my rate they refused very rudely and I told them to close my account. The customer service rep stated that it was in pending closed status until my balance was zero for one full billing cycle. I spoke to this reps :supervisor: who refused to help me. I told her to leave my account open, I would spend my reward miles pay off my balance then close my account. this rep informed me i had lost my miles by requesting my account to be closed. No one ever told me that would happen. They refused to return my miles although my account is still open and I can still charge on it. So they refused to close it, took my miles and would not reduce my rate. And to top it off, I told this supervisor -Kim- I wanted to speak to her supervisor and she told me there was no one above her. Hummm, she wasn't the president who by the way will not speak to customers. She also told me I would have a phone call from someone in 24-48 hours after I demanded someone else call me back. It has been four days and no phone call. Their email customer service told me I would need to handle this over the phone. Well I cannot get any help any where.

The garnishment of my pay could have been avoided. CapitalOne was negligent in issuing this credit card based on flimsy personal information submitted by the thief. The thief only had to provide my DOB and SSN. CapitalOne was negligent in their failure to conduct a proper investigation of the ID theft. When I contacted CapitalOne and made them aware of the ID theft they should have immediately initiated an investigation and that is according to CapitalOne’s own website (http://www.capitalone.com/credit101/fraud/victiminfo.shtml). Instead CapitalOne garnished my pay. CapitalOne attacked me and refused to tell me what kind of information I could provide in order to assist in the investigation. I was forced to try to resolve this issue without the help of CapitalOne. Both CapitalOne’s fraud operations and collections departments ignored my request for information and assistance. They ignored the evidence I submitted proving I was not in Detroit, Michigan during this time. Every certified letter I sent CapitalOne was ignored. CapitalOne made a mistake and refused to correct or acknowledge their mistake. CapitalOne refused to acknowledge the fact they extended credit to someone pretending to be me. CapitalOne chose to ignore the ID theft affidavit I submitted. CapitalOne chose to ignore my request for copies of account documents. CapitalOne chose not to take a report or initiate an investigation into my ID theft claim. In CapitalOne’s zeal to increase the number of card holders, CapitalOne failed to properly verify the personal information being submitted and failed to request enough personal information in order to sufficiently verify identity. CapitalOne chose to ignore my request to remove my name from this account and from the judgment until finally a ruling was issued in my favor by the 36th District Court. I was prepared to present a mountain of evidence to prove my case, but the lawyer for CapitalOne agreed the card was the result of ID theft before the trial began. The lawyer was dead set against me receiving anything other than the money CapitalOne fraudulently garnished from my pay, but the judge thought otherwise and awarded me the out of pocket expenses. I believe the turn around by CapitalOne was due to my complaint filed with the FRB. I would suggest others use them to file complaints against CapitalOne.

I applied for a printer lease and ws turned down and that prompted me to check my credit report. I then found a "charge off" that ws not mine. So....I filed disputes through the credit bureaus. I had 697 at the end of May and three months later, had 635 and the last time I checked it was below 600. I have five creditors and have NEVER been late. I have paid anywhere between $200 to $400 per month to each one but tring to fix my credit has made it worse. I also had about 8 inquiries on my file until I started trying to fix it and now I have 64. They are mine but I have no way to prove it and the more I try the further my score drops. They tried to get me to buy "identify theft" stff, credit monitoring and all that stuff and when I refused, all this other stuff, bad accounts and a zillion inquires showed up on my report. So...as my last resort, I have sent my file to the FTC in Washington DC, hoping that I can force the credit bureaus to fix my file back. My score should be about 750 - 800. I have proof of every payment made. I have printed off every statement of my CapitalOne MC, Household bank MC, Dell, GE and Visa. The cc companies have not cheated me. It is the credit bureaus that are placing info that is not mine because I would not pay them to monitor my credit.

Dan, the Customer Services is mean to charge u more fees and add your late fees 2 more days because "the local office is not IN, but your claim will be sent". I don’t live in Detroit now or during the time this card was opened. The card was issued in March 2002. I contacted the credit bureaus to remove the fraudulent information and they refuse. I contacted CapitalOne (1800 955-7070/ 1800 239-7054/ 1800 258-9319) to inform them of the ID theft. I was unable to resolve over the phone. I was transferred to various departments and they hung up on me several times, but I kept calling back. I called their collection agent (the law office of Mary Jane Elliott 248 306-2000); I request to supply evidence proving debt is not mine. Agent refuses to state what evidence is needed because they could not give me legal advice and they also hung up on me.

On 28 Sep 2005, I called the Detroit police (313 596-5900). I was told to file a report where I reside. I filed a police report locally (05-24222) (440 871-3311). I placed a 90-day alert on my credit report and filed a complaint with FTC (ref#6832758).

On 30 Sep 2005, I mailed certified letter with receipt to
CapitalOne Fraud Operations and one to CapitalOne Collections, notifying them of the ID theft along with ID theft affidavit, state driver’s license, proof of residency during the ID theft.

On 5 Oct 2005, I received email notification of garnishment from Celia Vazquez (216 204-1698) garnishment will begin on 7 Oct 2005. I called the 36th District Court, Detroit, MI (313 965-6144) for paperwork to dispute the garnishment.

On 13 Oct 2005, I filed a complaint with the Michigan State Attorney General Office (AG# 200515038).

On 25 Oct 2005, I filed a complaint with Comptroller of the currency Administrator of National Banks (www.occ.treas.gov/customer.htm

I believed I’ve contacted the appropriate organizations, but I still haven’t received a solution yet, meanwhile I lost $500 from my last paycheck for a debt I never created. The garnishment is supposed to run through Dec 2005. What else can I do? I haven’t heard back from 36th District Court, but I’m looking forward to my day in court.

The first card was secured and after three years of good payments I requested that my security deposit be refunded-they refused however they gave me a higher limit unsecured card-clearly I was a good standing customer so why did they keep my deposit? I canceled the secured card asking to use my 250.00 deposit in the account which was 300.00-they refused stating that I had to pay the card in full then they would refund the security deposit-is that legal? Anyway I made the minimum payment and they claimed that they got it late charging me a late fee which put me overlimit. I agreed to pay the 300.00 but refused to pay the late and overlimit fees. Ultimately they accumulated fees bringing my account to 750.00 put it in collection at that amount and never even deducted or accounted for the funds that they still have for security. Now I have this current card with them again good standing for years and suddenly I sign up for online payments. I get the next bill in the mail stating that I was late then overlimit because the E-check didn't clear I call my bank manager who called them to say that they never even tried to put through a check online and that I had plenty of money to cover it-they refused to remove the fees and disregarded everything the bank manger explained to them. HELP before the same thing happens again where can I go to take care of this is there a commission???

I was told they came back to them, because i had given them my street address ,and not my mailing address, I informed them that having an account with them as long as i had they new my mailing address by looking on my file. I ask them to just send my statements so i could send my payment on time i made approx 5 calls asking for my statements, ok my payment is due on the 19th of each month, and my statement was received on the 20th with a 35.00,dollar charge on one of them, and 29.00 dollars on the other. I informed them i didn't owe a late charge because they failed to send out my statements, so I received my statement for one of my cards for the month of aug.,so i called about the other one, and was told they would send another one even though they said they had already sent it. I deducted the late charge from the statement i did get, and sent it on out. I waited for the other statement, but it never came, so i called again, and was told it came back to them even though the correct address was on it.I ask what they expected me to do, that i did not plan to just mail them a money order without a statement or an account # to post on it, I ask for the account #.and was told they could not give me that info., so i ask for the last 4 digits,& was given that. I had no idea what amt to send, so i sent a payment of 50.00 dollars,when i told them i wasn't going to pay the late charges i was told they would add more if i didn't. I have had nothing but problem with capital since june when i called about the cards. I was searching the web tonight ,and found a # to call, the lady was very nice and listened while i explained what had happened the last 3 months.I was told by this lady that she could straightened this mess out for me & was sorry for the rudeness these people had shown me.I trust that she will. Louise, let me tell u one thing, some lady from CapitalOne tried to post therr message on our web by a FAKE contact info!! their salary depending on how much charges and fees they can ever squeeze out from u!! One regular trick is that they will charge u whatever and however they can, then the next guy will offer u 70% to settle. If u still refuse, the next guy will offer u 60% off. I once finally got the offer down to 30% off if I would willing to pay any. But they won't offer u any discount anymore after 1 year! Because u will lose the chance to sue them after 1 year.

U need to call' write (and keep all the records for the evidence for later) to tell them that u don't want their NO-HASSLE REWARDS at all! (Or else the day u open their new card, there will be a $69 annual fees automatically charge already!) If the card is already there, never activate it, cut it into half and mail it back to them with a letter tell them u do not activate it, and u DO NOT want their card! Although my credit report is somewhat accurate it is still a hassle. It has been about 5 years since this has happened to me. I also requested my account to be closed so as that i would not receive the overlimit and late charges, of course this never happened. Now i think about it they did settle wit me but a few weeks after they received my payment I received an arbitration letter in the mail. I see why now. They r nothing but a bunch of dirty bitches!! Also I would like a copy of the list of people that are already taking action on this so maybe i can send it to the credit bureaus and get this straightened out. It says you need my evidence to assure you that im real. Since the happened several years ago I have no hard evidence except what shows on my report. Basically its my word against theirs. Also its from my understanding that if you offer them payment and you have evident of this letters or recordings. If they deny you all you have to do is send it to the credit bureaus and they will delete them from your file.

matt, in some area, u can NOT sue the vampire for the over-1-year-old-credit-issue. Pay the most attention to your next month statement' find out the date they cashed your payment from your bank records and if CapitalOne  still post it as LATE,  and sue them for the current matter. U can always learn how to fight after u view our webs and find the witness with same experience from CapitalOne .

What's happening to all the victims is, when u send CapitalOne  the whole payment to close your CapitalOne  , CapitalOne  ALWAYS hide your payment and pretend that they never receive it ! And CapitalOne  will insist that u spend $10 to buy the photo copy of your own bank checking account to prove that your check does go throu, it usually take more than 2 months, then after u do the whole document procedures, CapitalOne  will credit back the amount that u finally prove u sent, but they will be more of fees and charges here and there, and u never get close your 24 hours CapitalOne   nightmare, that's happening to u?! Contact CapitalOne  and ask them to correct the error immediately! CapitalOne have their so called " CapitalOne Services" office set up in other English speaking countries, (India?! Surprised??) It's cheaper there, and u will always have SERVICE especially when u r mad and calling in the nighttime. They may tell u "The local office is closed, your case will be transferred tomorrow". Remember their salary is based on how much charges and fees they can make u pay, and by "transferred tomorrow" meaning your case will be 2 or 3 days more postponed, Why? more late charges of course. Contact and double check 3 major credit agency to make sure that CapitalOne have correct the error! I told them to cancel my credit card because it seemed like I would never be able to pay it off if it continued to remain open. So when I cancelled my card my balance was $466.71 and I was like cool, I can handle paying this off. So I waited to get my refund check from school and would pay off the entire $466.71, however the balance now was $984.96!!! What is really going on?!?! They called me and told me I need to resolve this matter and I told them that I would pay the $466 but I would NOT pay the $984. That is ridiculous and I am NOT paying for something that they should have closed. Now on my Credit Report it has Charge Off in the amount of $314 but then states I have a past due amount also. I am completely confused and will not pay them until they can send me some kind of documentation in the mail which shows how they added almost $500.00 in charges.

Two months pass and I've received no paper statement and I get a call from their collections, threatening to report this to the credit bureau if I don't pay within 2-weeks....oh and my initial APR of 8.9% is now 26% AND i've been assessed $105.00 in late fees. I'm livid and I've been a GOOD customer....but, no breaks and now the harassment begins. I would never intentionally STOP my paper billing. I paid on line to avoid late fees and this has happened to me. Oh, and the 'collector' couldn't tell me why I wasn't getting my bills, only that it wasn't CapitalOne's responsibility. I had to find this out from another customer service person, a supervisor who would do nothing, make no arrangement re: the late fees or the APR until they get their money.

Wen, it's a card with credit limit only $200 (but they told u that your credit limit could be upto over $150,000 dollars in the letter?! YEA RIGHT!! They a;so told u that u would get a piece of private island too!! and CapitalOne don't even call their card "Credit Card" anymore, they call it "NO-HASSLE-REWARDS"!!) What money can CapitalOne able to make from u? CapitalOne spend tons of money to mail everybody the invitation letter to get their blood sucking evil REWARDS,  to air TV commercial to make u become their new blood, how do they get these cost back?! Ben, let's know your url when it's ready. There r already TONS of web sites fighting vampire already. Doesn't really bother CapitalOne, everybody is watching 's TV commercials everyday, receiving 's "pre-approved" invitation letter every week. But most of viewers only find our webs after they have been blood sucken dried by CapitalOne, and always too late to sue. Sometimes those victims even getting 2 or 3 CapitalOne cards all with credit limit of $300 and still never figure out how evil this can be until they see our webs, which sadly to say, is always too late! CapitalOne keep change their promotion name so the web site viewer hardly connect to learn that we r fighting exactly their credit card, CapitalOne doesn't even call their card VISA or Master credit card anymore, yesterday we were fighting CapitalOneCard, then they promoted their card name into "no-hassleCard". Fine, we r fighting no-hassleCard. Now they change their card into "no-hassle-rewards". REWARDS?! what hell is that ? their TV commercials is very confused and annoying, but they r getting new blood everyday. It was sent. then on top of that a purchase check in my name for $200.00 dollars. what was I suppose to do with a purchase check in my name? go spend it at Macys? On top of that , they said it was a gift. Nothing for free in this world today. I took it to my bank just to see what was up with this odd check and deposited in my account since that was the only thing I could do. my bank said they had no record of my depositing any sort of check from capital. for 3 months they refused to admit they had seen any sort of check. I found out three months later with some help that it was sent back to capital one. Wells fargo do not accept purchase checks. They finally found this odd check . took $200.00 out of my account. which they never even put the check into my account. and CapitalOne charged me the same day that check was deposited into my account $200.00 to my card. after almost a year. CapitalOne said it was in their hands. I asked for a copy of the check which I do have. CapitalOne closed my account. I thought that was finished. NOPE. they sent me another card . I called and said I did not ask for another card. They tried to tell me it was a total different account , don't worry everything has been taken care of with the other. I refused to open the card. told them> NO I will not open this . CANCEL this card. I then got a statement the next month, And there was a $200.00 dollar charge on it. I was livid. how can they open an New account with out my consent . and on top of that add $200.00. to this day i'm fighting with them about this situation. I have the card with the sticker still across the card. I thought I had better keep it to show I didn't ask for another card , nor did I open the card. they are after me for now $450.00 , they say the other card was transferred to this account . they are nothing but a bunch of crooks. how do I stop this. ? In response, they demanded the payment in full, reduced my credit limit to cause over limit charges to be accessed, late fees and jammed up my interest. Since then I have secured employment but have gotten so far behind the account charged off. They are charging me 15.9% on a written-off amount. I know for a fact because I pulled my own credit report. I also asked for a settlement quote around mid jan/05 and Amanda gave me a quote of approx 75% of the balance, this equaled around $1K month for 6 months, I told her that was way too unrealistic. That was this past Jan/05. Well in March/05, she called again and tried to settle with me for 85% of the balance. I asked her to explain and she assured me that that was the best deal she could offer me. I wasn't able to do that either because she jacked us the settlement amount. I also asked to speak to a manager (I knew she was lying to me), she of course refused. Then I also asked why am I being charged 15.9% finance charge on a written off amount. And you know what she did? She laughed right in my ear. What professionalism and highly credible PR. I also have an MBNA account and that was running into charge-off. I called and explained my situation and they immediately agreed to settle for 25% of the balance in writing in which I am currently paying them off. I am also going to make a web site similar to yours, plus I have all documentation, 2 letters of charge offs and the amounts they jacked on there for interest, the settlement letter from MBNA. Plus even though I believe its not right to record conversations, I recorded the entire conversation, disagreeable settlements, not letting me talk to her supervisor and her laughing at me. I'll post all of my info on my web site here, stay tuned. Plus with me traveling to Philly, NYC and DC I am sure I can make up some flyers to promote my website and let these liars have it. CapitalOne assisted me with providing a credit card -well one became two.. three.. and then.. four.. my payments were being made on time until one month - I received a bill, my payment due was way over what I could afford - they said it was because I paid them late - I had a latefee and overlimit- I could not understand how I mail my payments two weeks in advance and now I was LATE!!! Unfortunately this dominoe effected on my account. All 4 accounts were charged off on my credit report because I could not afford these late/overlimit payments continuing to accrue. Now two years later - I am trying to get this cleared up - but every month they are still showing charged off on my credit report - they are still accruing balances. My $300 credit limit card is now saying I owe $1300. That is over $1000 in fees they have charged!! I know I should have paid these off and this is partially my fault for not paying my debt but at this point I absolutely refuse to pay them $1000 in fees (and that's just one of the cards!!!) Unfortunately this has caused a significant burden on my credit report - I want to make amends with what I owe - but am not at liberty to pay them this much in fees. Also how can they continue to charge $60/month in an account that they supposedly charged off two years ago? This doesn't make sense!! What should I do? Desperately in need of some guidenance....

Tabitha , Small Claims Court won't cost u any attorney fee to sue CapitalOne, but u only allow to use the court TWICE a year! (Yep! even u have 4 issues!!) U r not allowed to claim for more than $5,000. CapitalOne always give up to hire a lawman to appear for your lawsuit, BUT, if u claim for more than the lawman's cost, of course the bank will pay the lawman and face the court. SO, PLAN WELL and SUE the vampire GOOD!

Spouse unemployed and I have become disabled due to car accident. Gave them a call when I could no longer make payments but could not get them to work with me. Get calls from some one in collections and they are now threating fraud even though I always paid it off in full up until my spouse lost job and became unemployed longer than we anticipated. She was very rude today and even suggested we sell our home. What would that solve as that would put us in the street with a family of 6. FYI we have only had 2 credit cards in the 17 yrs. we've been married.

I Have told them that their mail when my children see it causes, because they get home before I do, extreme duress for my children because my x wife kidnapped them beat them and hurt them physically and emotionally. Yet after phone call and phone call to them to get it stopped they continue to call. They even violate the fair debt collection act. I told the collection dept that she doesn't live here don't call. They still do. Just when my new wife and I get our kids (My new wife takes care of 4 children as her own) back away from the fear of being abducted again or hurt from her along comes CapitalOne  with a phone call or 5 items a mail a month. I have to tell my 16 yr old that she can't answer the phone till the answering machine screens the calls. She wants a normal teenage life. Her girl friends call all the time and so does CapitalOne . Does anyone know a good attorney that would be willing to file against CapitalOne  for the costs of counseling pain suffering mental and physical duress that the stress causes. I am going going grey and I am only 36 from the stress.

I even have payment protection on my CapitalOne card and can't use it because I wasn't sick long enough! I missed one $15 minimum payment while I was sick and have been fee'd to death, spoken to like I was a low life, and reported negatively to the all the Credit Bureaus just so CapitalOne can further increase their corporate friendly status. Then, when I became a targeted identity theft victim, I closed my checking account at my hometown bank and opened a new one. Well, I neglected to change the account info online at CapitalOne and made a payment that ended up "bouncing" back to them. But wait! I realized this after I made the payment and well before the due date, so I call CapitalOne to get it straightened out and make a payment from my new checking account. Low and behold, the new statement comes with MORE FEES due to a "returned payment". I call them back and say "Hey, but I called and fixed this immediately". CapitalOne 's response was "We can't do anything for you unless you get a letter from your Bank stating that you had another account with the funds available on the date you made your online payment so we can verify that this is true." I said " well, you can see the payment I made that is posted can't you?" "Well, we still need verification from your bank". Further proof how CapitalOne trains their representatives to be rude, stupid and treat their customers like low-lives. They can't even see the truth when they POST IT THEMSELVES! Anyway, now they have me $75 over my measly $300 credit limit. I have several other credit cards, all in perfect standing. But that means nothing to them. It also means nothing to them that I have never been late nor missed a payment in the history of having the card! Nor does it mean anything that I missed the payment when I was out of work sick. I didn't notice until I went to pay my next months payment. I now owed a double payment with a late charge. I called customer service for help. I did not have enough to pay a double payment of $700. They said I needed to get caught up or I'll be 30 days late. I agreed to pay the last payment and late fee. They made it sound like they were going to do it for me over the phone. I could have just clicked 'PAY PAYMENT' online if I had realized that was not the case. I was over 30 days late once I noticed It wasn't deducted from my account. I'm now deeper in the hole with more late fees and a bad mark on my credit report. I've transferred most of my account to another credit card!

On Saturday it was $149 and on Monday it was $75. I immediately called a customer rep to say that I was sending in $25 since I had a $90 bill coming in right away. Even though the check for $25 came in within three days, CapitalOne  billed my account $29 for exceeding my credit limit. I spoke to three customer service managers today - Chris, Cliff and Walter - and none would take the $29 off my account.

I went through all the checks and obtained a copy of the check from my bank. CapitalOne changed the amount of the check and ignored the correct account number at the bottom of the check and credited the wrong account. The check amount should have been $104.00 which is clearly written on the check and not $160.00. The credited the $160 to the wrong account which now has an overage. They increased the check amount and added a late fee. How do I join the legal action again CapitalOne? I will mail a copy of the check to you at the contact address.

1.We r not CapitalOne's site! We r fighting this blood sucking evil vampire!

2. Every approved credit card  CapitalOne sending out r all "pre-approved", don't need to be proud or excited! U r getting a "Debt u to Death" credit card with credit limit $300 (or $200 if u seems be a low level new blood), yep! even the gas card have higher credit limit than this "No-Hassle REWARDS"!! Why the credit limit so low? because CapitalOne want to charge u over-limit fees everytime u use it. Doesn't matter how and when u pay the payment, your payment is always late so CapitalOne will charge u LATE FEES.

3.Most viewers find our webs after they r blood-dried and realized they r too late to fight the vampire. In some areas, u only allow to sue CapitalOne within 1 year or so. U find our web before u receive the card!

I applied for a CapitalOne card online and received it immediately. I did not activate the card for months. Once I did activate it I used it once or twice for purchases less than $200.00. I made payments to clear the balance. But even after clearing the balance and trying to close the account they refused to close it. CapitalOne wanted me to pay additional interest in order to settle the account. They turned my account over to a collection agency and threatened wish called me over and over again. I then made arrangements to settle the account, sent the payments and still CapitalOne insists that I owe them over $1,400.00 dollars because they refused to close they are saying that they never received correspondence from the collection agency. This is the biggest crock of mess I have ever heard off. They continued to put this information on my credit report. I have tried to talk to them over the telephone to clear this mess up, but that has been to no avail. They have the tackiest customer service people. One girl by the named of Rokeisha is extremely rude. But with a name like that, what else can you expect. Please for all concerned do not use these cards!!!!!

First they gave me a certain credit limit and said that my interest rate wouldn't be that high, then out of the blue they lowered my credit limit and upped my interest rate. So I went from paying a minimal balance of $20 a month to now having to pay $300 a month. No matter how much I pay I am always getting the run around. I received a letter from them stating that: We are concerned because your CapitalOne account is still passed due, and your credit rating is at risk. If you are having difficulties and cannot pay the amount due, please call us. Our associates are polite, friendly and skilled at helping valued customers in difficult situations. They can create a payment option that fits your particular needs. YEAH RIGHT!!! I try calling and again get the run around. You never get a straight answer with these people. I called when they changed my credit limit to see why they had done that. I was paying my bill on time every month. As a matter of fact it was taken out of my checking account. So how in he hell could I get charged late fees if is was automatically deducted from my checking account through Check by phone. I had to open a new check account because I was not going to pay them until I got some answers. No they say I owe $5,000. I say got to H***. When I called to complain they said, " we sent something along with your paper statement" I had told a rep with them months earlier that I never receive much less read the statements because I pay online for faster turn-around time. When I asked why my rate was raised I was sent to a manager, followed by another and another. The 5th person I talked to told me, " If you would have canceled your card when we sent the notice then you would still have a 9.9% apr. But because you didn't its now 15.9% !!!. I canceled my card as soon as she said this, but my new rate is 15.9% for no reason other than GREED. Again, I NEVER MISSED A PAYMENT AND NEVER EVEN PAID CLOSE TO THE MINIMUM. I am now trying to pay my card off ASAP because a 6% difference when you have a 6,000 credit is quite a bit. I also found it a little odd that this only happened after I quit using the card at all. I was using the card for gas, food, ect. and paying all that off every month + 200-300, but when I just started paying 200-300 and wasn't putting anything else on this happens. PS. I had deactivated the card and paid it off in 2002, it is now 2005. I call CapitalOne   and they have turned it over to a legal firm which says they will settle for $800 if paid by the 13th January, 2005 or they say they will proceed to court. I recontacted CapitalOne  to ask more questions and when I pushed more about having paid off the card and cancelled it in 2002 they told me that I had paid off a card, but it was a Visa and the card that was turned over to the lawyers was a Master Card. As far as I know the only card I ever had with CapitalOne  was a Master Card. This brings me to the question who's Visa card was I paying off instead of my Master Card. The said they were starting and inquiry and I would be contacted in the next 24 to 48 hours. For some reason, mainly some of the previous cases on the web site, I do not feel they will find anything but to their own benefit. Please advise if you can be of any assistance. Thank you

There was one sergeant post his complaint from Irak, then right away, the media (and also of course, the blood sucking evil CapitalOne) contacted us, I forwarded his contact info.

Enchance recovery is the next caller thet are hell hounds you tell them what you can send and they dont want it then they start this calling constant thing some of my cards already had 299 dollars charged on a matter fact four of the cards were like that and they hounds you to pay off what they put on and that not fair.

It took them 3 weeks to post my check and I was hit with an over the limit fee and a late fee. Since then I have had late fees added to my account every month. I requested that my account be closed and they refused. I have refused to pay them and am now dealing with their collection people at NCO. I have even been told by representatives from CapitalOne  and NCO that my account will be zero'ed out and I will owe nothing and two days later I receive a harassing phone call demanding payment of the account. I am tired of dealing with these idiots! I am interested in suing them but wondered if there was any type of class action lawsuit in process against them as well?

In my divorce, I was the one in charge of paying them off. I agreed to a "settlement" of the account with a company that claimed to be owned by CapitalOne . They assured me that this would settle the account and everything would be closed.

It is now three years later. The account has been reporting the last three years as a settled account, no balance, no activity.

I went to finance a house last month, and lo and behold...I am now the proud owner of a
CapitalOne  credit card that has NO BALANCE but has been 90 DAYS LATE 11 times SINCE LAST MONTH.

AGAIN, I am in possession of two credit reports...one from last month and one from this month. From last month to this month
I somehow acquired 11 NINETY DAY LATES.

I saved all correspondence when this account was closed and paid for.

How do approach this in small claims court? What do I base my case on? I am more than happy to sue them and want to make sure that capital one never has the right to do this to my credit report again. From last month to this month, my credit score dropped 80 points!!!! HELP.

Mario, bad news, CapitalOne  takes all kind of payments, and doesn't matter how and when u pay your payment, u always get late charges. If u read through our webs, u will see that there r some CapitalOne  victims complained about they paid by web, and it toke 2 or 3 hours to go through the procedure, then it toke 2 or 3 days to see the amount credited to their accounts.

My account limit was for five hundred dollars only, but it seem I could never pay it down.

Consumer protection is only for the wealthy these days. FICO knows 24 hours or less when you miss a payment or max an account. They have more power over you and your future than any existing political system. Try repairing your credit while we still have some rights. Finally brought my FICO from 620 to 710 but took 50 manhours + 7 months time. Just research how to do it but not with any third party. Always dispute the entire negative account and leave it at that since admitting any part means verification. Try too many times and you are blocked from repairing. Always have a reason or more documentation when you dispute and its all good. Dispute over the holidays and be surprised how few can respond to the 30 day requirement. Document everything.

I sent the payment on the 6th of November when I received the bill. I received ANOTHER BILL, for the 15.00 and an additional LATE fee of 30.00. ON November 18. Oh, and some TRANSACTION fees!!??? I called and could not get an operator....so I searched the web for numbers so I could talk to a HUMAN! I had to call several numbers before I tricked the automated system into giving me a LIVE person. They would not talk to me because I was not the primary card holder my husband was...he had called them several times to authorize me during the time we had the card. He works for weeks away from home. So, at 1:30 a.m. After picking the poor man up from his work he had to call them... He was furious because he had THOUGHT he paid them off when he paid them off with an over the phone check. Anyways our NEW BALANCE was a total of $44. 97 . My husband told him he wanted to pay it off and for them to include the $10.00 service charge so it would be done and over with. The rep told him that he only had to pay $44.83 to close the account out. We asked over and over why our statement said our balance was $44.97 and we were only paying $44.83 to close and if the So called service fee was included. The rep (sounded like he was from India) assured us it was only $44.83. We would not get another bill EVER, NO MORE CHARGES OR NOTHING! My husband and I told the rep we wanted to pay the New Balance of $44 .97 and $10.00 Just to make sure. He wouldn't let us. He said that would create a negative balance and the account would stay open. I SWEAR if we get a bill next month...I will drive down the CapitalOne  headquarters!

Kris, CapitalOne won't let u out easy! NO MORE CHARGES OR NOTHING??! ur payment always be late and u think it's ur fault? their over limit fee is $39 and u don't know why they never increase ur credit limit ($300? u be surprised to learn that lots of new blood got the card with credit limit $200!) they need to make at least $1,000 on each account. Don't waste ur time try to deal with CapitalOne Services. CapitalOne set up their reps in outside country of USA!! and u r right! yes, most of their reps offices are at India! It's a guarantee that ur complaint will reach the local office 2 more days late!!

The following month I received the statement showing the balance in zero, meaning the account was supposed to be finally closed, but it wasn't, time when all headaches started. The following month I received a statement with the $59.00 "ANNUAL MEMBERSHIP FEE" and I called to have this fee credit back. Apparently I called after the statement closing date, which consequently added a $29.00 late fee, that I had to call on a second time to have reversed, but it didn't stop there. Two months later I received another statement with their precious "PRIVACY GUARD" accompanied by their $59.95 fee, which by the way I canceled the year before, because I requested my credit report two times and nothing was sent to me. Then I called them the third time to have this fee reversed and was told by the representative that the fee was going to be reversed and the account was going to be finally closed, but one more time it didn't happen. The next month I received a statement showing a partial credit for the fee with an interesting addition of a $29.00 late fee. One more time I called them to have this charges reversed, but as usual they only did half of it, crediting back only the $29.00 fee. The following month the same story was repeated with the $29.00 late fee because there was still a balance of $5.00 in the account form the privacy guard. At this time according to them I was late on my payment from the previous month, reason why they decided to send to the credit bureaus their notice that I was late for more than 30 days, oh! but hold on, didn't I paid in full the balance in March and requested to have the account closed by then????. How can this financial institution send false information to the credit bureaus, when none of all the charges that were on there, were supposed to be there in the first place. I’ve never been late on a payment of any kind having the blessing of good credit and now it’s been threatened by their own. Isn't this illegal and unlawful. Obviously we speak a different language because I don't know how can many mistakes be done by different incompetent representatives. I called them recently to see if they could finally solve this situation and I was told that because of the complexity of my case, this problem was going to be taken care of by another department and it should be solve, but should I believe them after everything that has happened. The numerous calls I don't mind, their stupid mistakes neither, but sending misleading information to the credit bureaus its what scares me, because I worked very hard as many people in this country to build good credit. If there's anyone with any advice to what should I do please write back. I would gladly appreciated.

Alfredo, they don't make  mistake, they are doing such and such (read through our web, u will see they r doing this to EVERYBODY! They have to do this to make living, basically it cost them $500 to get a new blood, they need to make at least $1,000 on each account to make their business grow. What they want is to confuse and stall you from suing them within 1 year. If u don't get to sue them within 1 year, ur veins r all theirs, debt u to death.

I never spent $600.00, but I did owe around $545 and some change when I lost my job. I sent them my card and explained my position. I asked to close out my account and pay them so much a month. They refused to close my account and finally settled with me this October for over $2,000.00 in late fees and interest charges over the years.

(I only post ur message here once) Last time when I paid them in full and tried to close their evil blood sucking cards (Yes! My money problem began with serious family problems, etc. I would pay an outrageous amount for 3 months with the hope of getting on some "payment arrangement". Well, that payment arrangement was unspeakable. Meantime, the charges are still mounting. I have turned this over to a debt settlement company who has power of attorney, etc. They STILL call me at work, I in turn report them to the debt settlement company. Business as they do it should be criminal. Especially the way the economy and world is today, someone who calls and tries to make it right continues to get threatened and it will ruin your health and your life. Please include me in this lawsuit.

I know that CapitalOne spend tons of money on TV and newspaper promotion, so it's not easy to see NEWS report CapitalOne crimes and lose CapitalOne big fat promo account. I have been responding to their advertising claiming lower interest rates, and balance transfers, with high credit limits, only to get approved for a very low credit limit. The result is I now have 4 CapitalOne accounts, one with a $6,800 limit with a high interest rate, which is maxed, and 3 smaller accounts with $300 or less limits. Now I am paying $15 to $30 on each of these lower limit cards combined with my $200 payment on the higher balance card totallying almost $300 a month. Also, having all these accounts damages my credit history, but they will not combine my cards to help me out. I am paying the cards minimum at least every month, but wasting my money paying so many accounts. Why won't they combine all 4 accounts into the higher account and lower my interest, and obviously helping my credit.

I still do not have all of them .it appears that in the last year they have charge me over a 100.00 in late fees and over 6000, 00 on credit cards with limits totaling 2500.00 dollars. they refuse to respond to written letters, and they are now telling me I have another account I know nothing about. they pretend to be helpful but give me absolutely nothing when and if I m able to make contact with them. should I pay an attorney to handle this or should I file, should I refuse to pay them. a this point it does not seem to make a difference. I am afraid to pay tem off because is suspect they will try to change the final payoff amount. what is best way to proceed? Complaining does no take care of the problem. these people are operating on the fringes of the law. how can they get away with this?

Finally, after 4 yrs., and rebuild my credit and maintaining good credit, I have obtain a Visa Card from my credit union and transferred all the outstanding balances from my CapitalOne  visa to my credit union visa credit card. Pauline, this is not it! It cost CapitalOne over $500 to get a new blood like u, they won't let u OUT until they make over $1,000 over your account. It is a DebtYouToDeath deal. late fee' over charge fee' whatever, u signed it! u gave them your social security number and all the info. If u don't sue CapitalOne within year or so, CapitalOne will post you bad credit report, and schedule to list your bad credit for 7 years!

First couple months they said that my checks were in late charging me late fees and let me fill up my tank if there is even $1 on the card so I get to pay $65 for a tank of gas. Anyways, now I have auto bill pay and they aren't even taking the $ out of my account and charging me late and overage charges because the money was supposed to be debited on the 15th so I use my card and they say that I used my card on the 15th or 16th and put me over, sorry if this doesn't make sense JUST DON'T GET CapitalOne  !!!!!!!!!!!!!!

Payments are usually late even if you mail it in 5 days earlier. I've talked with the postmaster, he stated that it will be delivered in 2 business days. Are they posting payments late to add on late charges? Some of their customer service rep. are so nasty and rude, I wrote a letter to CapitalOne president concerning this. I've also tried paying on line, but it always says my card number is incorrect.

Bob & Diana, basically what we do is only post the message and save the contact info in secure. I usually don't forward viewer's post to media until I receive a message like yours. (Every time I forward our viewer's message to media, even sometimes I can get some media's attention to expose  and uncover those vampirism business, what's really happening was CapitalOne changed their promo campaign from "capital One Card" to "no Hassle Card" (because I started http://www.capital1card.com  to expose them). changed from "no Hassle Card" to "no Hassle REWARD" (because I started http://www.no-hassleCard.com  to uncover them). I made a small dollar purchase on e-bay using paypal and when I got my statement the next month, the on-line purchase put me $3 overlimit. This was 4 years ago and now my credit report shows I owe them nearly $1,200.00 in late/overlimit charges. Tried to cancel my card, so they wouldn't keep charging late fees but they refused. Now it's in recovery and I keep getting nice letters saying they'll work w/me but every time I call I get disinterested reps who won't let me talk to supervisors or managers. They insist I pay $800 to settle for less. But I don't feel I should pay that, let alone $1,400 because I went $3.00 overlimit.

I refuse to pay for a credit card that was stolen and bringing my fico score lower. I have a letter from the fraud dept from fraud manager releasing me from paying on this stolen credit card. I need some legal advice on credit card fraud protection and resolve this situation in a professional and legal way. such as my rights verifications on contracts from sais company. any information would be deeply appreciated asap! thank you!

Dear CapitalOne victims: You may think your story with CapitalOne is different, but let me tell you exactly what CapitalOne's been doing to every victim (YES! INCLUDING YOU!!): CapitalOne need to create all kind of traps and plots to make you pay at least $500 on you account. Why? Because it cost CapitalOne at least $500 to get you become their CapitalOne NO-HASSLE card holder! You don't pay up to $500, they consider they lose money on your account! You won't get your credit limit increased! You won't get your account closed even you pay off the balance and cancel it. NO WAY! Another crucial trick that I need to tell you is: By law, you only allow to sue them for the current events occurred within ONE YEAR! Any trick CapitalOne got you, if it's over ONE YEAR, BINGO! it's FREE crime! CapitalOne will hold on it and keep charging on you FOREVER! Debt you to death. They have helped to ruin my credit for the last 6 and the next 7 years. I was a victim of fraud in Puerto Rico with this card 6 years ago, and I cannot get CapitalOne to respond despite at least 30 efforts. Only their collection agencies and threatening letters. I proved to CapitalOne 6 years ago the hotel double charged me and charged bogus fees additionally, and had all receipts, etc. but they claimed I gave authorization for a charge and that could be any amount, therefore my responsibility. I had a $600 limit, and + 1500 was charged and apparently paid by CapitalOne. Further I have been a complete victim of every similar complaint on this site re: CapitalOne. Not posting fees, changing interest rates and agreements with no written notice. Not posting any payments on time, and high late fees then overlimit fees as well. My once in good standing $600 credit card which I closed 6 years ago now sits at +$2,500.00, and I have not been able to obtain a decent credit line since. CapitalOne's story is that they cannot be responsible for charges out of the country and they do not use standard approval codes in Puerto Rico, therefore I am responsible regardless what happened. Now, there is more...A collection agency called me 3 years ago to settle and I did. I paid $400 which was my original balance when I went to Puerto rico. he agreed that was fair. It was never credited to CapitalOne, nor do they take any responsibility for their credit agencies actions but they know this happens. So, 2 months ago, a new agency takes over, threatens to sue, offers a settlement AGAIN at +$800. I refuse and exercise my right to dispute in writing and by phone to both the agency and to CapitalOne. It says they will respond within 30 days. It has been 60. Almost everyday I get threatening letters to pay or be sued. I am NOT GOING TO PAY THIS DEBT I DO NOT OWE!!!! It has cost me tens of thousands of dollars in additional interest rates over 6 years to have this on my credit. That is payment enough. The damage is already done.....long before I knew what happening. I have complained to every branch of the Government, the Attorney General three times, the banking industry folks, every department at CapitalOne there is that I could think of. TO DATE MIND YOU, not one response, other than we are logging your complaint. Lastly on this, I have disputed several times with each credit reporting agency as the law allows. In each case they replied (not all did) after 30 days they reported to me that "the debt is owed, and confirmed by CapitalOne". Thus, it stays reporting. It is basically late for 6 years, and a charge off. I keep putting in requests to dispute or have a note on there that it was fraud out of the country, and they will not add it as the law allows. How is it that I could certainly not ever take that card to the limit or I should say over the limit by one cent ....but a hotel in Puerto Rico can charge $1,500 on a $200 remaining balance and it is paid without question?  Something wrong here. For the record, the US owned Hotel said they just lease the name to them there and are not responsible either, but agreed it was clearly fraud and there have been other instances. Any suggestions?? Should I sue? If so, what would be the charge and where would I get an attorney? I am certainly not going to pay one more cent. All this has forced me into providian creditville who is a whole other nightmare. Much worse than CapitalOne. They are lying thieves of the worst kind. Every payment is witheld until late fees accrue. They can pick any month they want to hit the annual fee even though it is only 9 months later. Whenever it is JUST right to send you $1 over your limit. Finally after years of their hell, they admitted that with them you SHOULD NEVER CHARGE YOUR CARD TO WITHIN $100 OF THE LIMIT IF YOU WANT TO STAY UNDER IT AND IN GOOD STANDING. That is without ever using the card. All of these companies should be shut down permanently, and the credit reporting agencies with them also!!! They are every bit as guilty, and have a profound effect on everyone's life these days. Everything is completely controlled by them, from jobs to credit cards to homes to cars, and they simply do not care! It is terrible. If I didn't work for a living 80+ hours a week, I would spend my days (all of them) working to change that whole system. If I hit the lottery, I will do it full time....but I will never ever pay CapitalOne for this scam. thanks for listening everyone!

CapitalOne forced me to terminate my card against my will because they refused to negotiate my account. I needed to have my account suspended for 6 months to a year until the balance is paid in full. I can only pay $50 a month due to medical crisis and financial hardship. CapitalOne lowered my finance charge to 11% and waivered my payment twice however it still didn't help me any because I don't have any income since my surgery to pay the finance charge or minimum payment. Also, calls are often transferred to INDIA for customer service problems or inquiries. The Indians often cannot answer questions due to they are not in the USA. If you ask their location they usually reply "AN Offshore Location"

I called & got a hateful rep who refused to let me speak to a supervisor, wrote them a letter which they ignored for 6 weeks or longer, and have just sent me a letter offering to "help" if I am in financial trouble. I told them in the letter I wrote to them first that I was not going to be "taken" for a fool and pay for what I do not owe. They didn't contact me, so didn't make June payment which is when I first noticed they'd increased the % rate, nor the July payment thus far. So I should take them to small claims court here in South Carolina? My husband has the same problem with them and he followed the same procedure as I did but to no avail. Has not heard a word from them about straightening this out and the balances just keep getting higher with their fees. They also just started out of the blue charging a monthly membership fee!

Alice, could u tell us that why ur husband couldn't get them in small claims court? Remember u need to sue them within 1 year.

During the phone call, automated, my cell phone disconnected before any information had been confirmed. In June, 2004, I had a mailbox forwarded to a new address, it was my student mailbox, and nothing was being sent there other than student materials, as far as I knew. But in the letters forwarded, I had 4 credit card bills, and one envelope containing the inactivated capital one visa. The bills included an activation fee, and subsequent late fees for 4 months of nonpayment. I asked CapitalOne how they could do that if I never activated the card, and why had they not tried to contact me by phone if they had never heard from me. I could have died. Bad customer service, fraudulent activation of the card, and it is by the very company that issued the card. Also, there are now late pays on my credit, and C1 said they would send a letter to the Credit Bureau, and to me, but 30 days have passed. What can I do now?

Sorry to see I'm not the only one/ 7/12/2004 6:09:18 PM/ Rita T*" /Rit*@hotmail.com / Hi There, CapitalOne lures you into the convenience of email statements.  The first few months everything is fine, they offer you a second card and the nightmare begins.  Either the statement arrives on or beyond the due date and they nail you a $29.00 late fee, or no statement arrives, you don't make the payment and you'e got the $29.00 late fee.  These past two months, two email statements arrived for the same account, which I didn't notice.  I opened both, followed the link, paid what I thought was both accounts and would up double paying one account and getting a snotty phone call about the unpaid account.  I complained to the caller, she gave me the correct # to call, 10 minute wait, and then some idiot telling me how ashamed he was to see that my account was in arrears.  Call another #, and advised to go back to paper statements if I wasn't getting my email statements or take it upon myself to keep track of my due date.  Informed her that the offer the convenience of email statements so that we didn't have to keep track of due dates and that while waiting for her on the line, I discovered in their web site that the reason I didn't get a statement was because I hadn't used the card.  Asked why I wasn't informed that if I didn't use the card there would be no statement.  This is a pure and simple scam.  Double email one account statement knowing a person will assume that they're paying both accounts for the month, hit the account with late charges and wait until two months worth of late charges have accrued to call. I contacted CapitalOne and informed them it had been canceled. They corrected the matter and sent me a letter saying, I owed a zero balance and the card was canceled. Six months later I am contacted by an attorney for CapitalOne saying I owe them a $1,000.00 dollars and am being sued. I told the lawyer I don't know about this card unless It was the One I had and was closed a year before I closed the second one. I had even called the company when I received the correction notice and they informed me everything was finished and our business was concluded. I go off to school and this lawyer who was suppose to investigate this card problem never faxes me back at work, but he does get a judgment. And he kept sending apparently registered mail to my apt. in a name that is not my legal name, but one that I used when I was married 20 years ago. I have not used that name since it was legally changed back to my maiden name 20 years ago. My roommate did not acknowledge it because he thought it was mail by mistake. I was rarely ever home because of school I stayed with people in my clinical and had told this lawyer that was the case. I feel like I had a fast one pulled on me. I am back in my apt now that school is finished, and am being threatened to have leans and seizures against me and I still don't even have information on this card. Thank-you.

They did not cancel the card, added a $6.57 MCI charge of questionable origin and then charged $387.16 in fees and late charges because the $6.57 was not paid. When I found it on my credit report and tried to call them they were very rude, refused to give last names and stated their were no supervisors available. They stated they do not honor written requests to cancel accounts only phone ones.

When I cancelled I did so becaue I saw that at the rate they were charging me I would not get this credit card paid off for a long time the way they do all of the late fees, over limit fees and high interest rate!!! There is nothing I can do about it...I decided not to pay it at all because I am wasting my money for nothing - I don't even have any merchandise to show for all of this...but then I am wondering if they can charge me late fees for the rest of my life if I never pay the balance and let them charge the card off!?!?

Called them and they were quite rude about our past dealings with being late. They made it a little difficult to stay current by assessing first a late fee because we made a supposed late payment online that they said was late because of the time difference, and then because they charged us a 29 dollar late fee, they would then charge us a 29 dollar over the limit fee. Totaling 58 dollars each time. Even after paying all this money and taking away from my families well being they still cannot give us any break and decent customer service. HOW CAN CapitalOne KEEP GETTING AWAY WITH THESE THINGS, AND RAPE OUR AMERICAN FAMILIES?????

I don't know if it is too late or even how to handle this problem.  I had a CapitalOne card in 2001. It was a card to begin your credit for $100. Once I signed for the card and activated it they went and purchased an old repossession that was no longer on my credit report with out my permission. I have argued with these people, contacted the Better Business Bureau, and the Federal Trade Commission with no results so I guess I'd contacting the wrong people. I have contacted the Manager there that found my paper work and he faxed me a copy while telling me they don't have any permission on file or any paperwork that I signed due to being lost but that they didn't need any permission to charge things to my credit card because they were the bank for it. They don't even have my signature. My $100 credit card is now almost $11000 and building. This can't be legal and I don't know who to contact to help me. It is ruining my credit making it difficult for me to live a normal life. Can you help me or point me in the right direction.  Thank you, Mary

The collection agencies name was M.R.S. and we reached a settlement on 29APR03 for just over $1,700. Recently I had my credit report pulled and CapitalOne card that I settled on with M.R.S. showed up as an outstanding account. I called CapitalOne to clear up the 'mistake' and they claimed they would send me a letter stating the account was closed. That was 6 days ago. I called them back today and they had re-opened the account and sent it to another collection agency for $4,600! Now, I'm trying to clear this up! What a hassle! The old collection agency is showing the account closed. The new collection agency, OSI, is showing it was settled on 29April03. But CapitalOne  told me they would investigate it and to call them back in 5 to 7 working days. I'm trying to buy a house and need this resolved. Please help me! Since I am already disabled My income is guaranteed. Constantly adding Overlimit fees upon membership renewal if that money is not there. Overlimit fees for finance charges. If one cent over an overlimit fee is added. Latest incident I feel was totally unfair was when I filed a discrepancy on a charge I did not authorize. They say they put the money back in my account on their own as a courtesy, but did not let me know so. then the company that made the charge the money to my account put the money back in within a few days of my starting the dispute . but. the next month my statement showed neither transaction and showed a balance of both so I made a necessary charge and paid my normal monthly payment. Then 3 days later I had an overlimit fee of $29.00 plus within 2 weeks I had a second fee of $29.00 for a late payment since the payment I made was apparently no longer enough. These are not fair tactics or charges. Customer service was very discourteous when I called for an explanation. By the way I only found out about all of this by calling the automated number for a balance. I have 3 CapitalOne cards 2 visa and 1 master card and ALL 3 are constantly hitting me with these fees. My husband also has one and they do the same to him. We are disabled and on a fixed income and these fees really hurt. If possible can we join in this lawsuit. They are a very unethical bank to say the least. Thank you for doing something about them , but I am afraid this will not change the way they do business  although I do hope it will.

Jacqueline, it only cost u around $22 to sue the CapitalOne vampires DIY (Do It Yourself)! Don't wait or u may lose ur chance, u only allowed to sue them within 1 year or so!

I just moved back to the States from Canada and am trying to change over to a US bank. I have been trying to do this for 10 days. Each time I called, I was told that someone from the accounting  office would contact me to submit an application. No one called. Each time I called, I was told that they would "forward my request". I was also told that "there was no number I could call- I would have to wait to BE CALLED". I got fed up, and called again just now to cancel my card. The supervisor with whom I spoke, told me that she could transfer me to someone who would take my request immediately. I said, "what the heck". She transferred me to a freaking' automated system. The application takes 4 weeks, and I'm doubtful that it will go through because I've only been at my US address for 4 weeks. I think this is B.S. I am a current customer! I had no trouble when I changed banks when I moved to Canada from the states. The Canadian Bank mailed me a new card within 1 week (and after 1 phone call). As soon as I receive a credit card from a different bank, I am closing my CapitalOne account. Oh, and one of the "supervisors" was just plain rude to me for no reason. Sincerely, Lisa

During this time my $1,000 limit CapitalOne  VISA was not paid and for many months got $29 late fee and $29 over limit fee (their fees put it over limit). Last year I discussed it with them and they agreed that about $850 was owed. They said that when I paid half (I paid them $450) they would remove all records of the account from all credit bureaus and set up a three payment plan for me to pay the balance. Once they got my $450 they developed convenient amnesia and did not do as they had promised. Now I get several phone calls a day (one every morning about 8:15 from a LaToya at 770-248-2287). My fax machine picks up these calls, but it does not deter LaToys from calling several more times every day, Sundays included. I have a severe heart condition and this harassment has further stressed my health. Please add me to your class. As I write this (11:30 AM on a Sunday) the phone just rand and it was the above phone number.

Robert, u need to sue them DIY (do it urself), it only cost u around $22 to fight the vampires. Class Action take years and only the attorney getting the money.

Check this out my limit was only $300, the first year I made payments (on time) but I could never seem to pay it off with all the extra fees they add every month. So eventually I stop. Even though my limit was $300 and after all the late fee and interest rate they added now my balance is $1,700!! How in the world!!!...So for an agreement I told them I was willing to give them an extra $200 + my original $300 = $500 to pay off my account. They told me NO!! I'm thinking you weren't getting any money out of me before why will you turn me down to make a settlement thank God that I was willing to try. Anyone who is an Executive over the accounts should definitely get on their case about NOT accepting money is LOSING money. I will love to get information on who I can speak to on this matter.

You use the card, pay it in full each month and amazingly enough you pay no fees. I have a CapitalOne  card and a Bank of America card. I pay my bill online and NEVER have I paid any interest or fees. I think instead of spending time talking about how you have been ripped off by credit card companies, you should:
1)Educate yourself on how to use credit responsibly
2)Use cash

I should also mention that I used to manage on of the largest payment operation centers in the country. We posted ALL payments the day they were received, if they we received by 3:00PM. We had the mail delivered every few hours to ensure we got every payment possible. Every piece of mail was tracked and assigned a marker showing the day it was received. This enabled us to backdate the payments in the rare event that something kept us from posting every thing same day. In my former line of work I had the opportunity to tour the payment operations of nearly every major credit card company (BankOne, Capital One, American Express, Citibank)
There is no staging or holding of the payments. There is no evil plot to try and charge you late fees. Everything was incredibly automated and check for quality and accuracy throughout the process. We processed 24 hours a day 365 days a year to ensure your payments were posted promptly. I realize that it might make you feel better to blame someone else for your errors, but complaining about it doesn't fix the root cause, which is your lack of knowledge on how to use credit. I know you probably won't post this because it doesn't support your cause. I just hope it prompts you to take responsibility for your actions in the future.

CapitalOne  cards, I complained about the tricks they did and canceled 1st one. They gave me 3rd card with higher credit limit ($1,500) and told me it would be BETTER.

(How did I started to have 2 CapitalOne blood sucking evil cards anyway? CapitalOne offered me credit limit $500 if I gave them $500 deposit, I did so I got 1st one. Then CapitalOne offered me 2nd card with 3 times credit limit if I gave them any other amount, so I gave them another $400 to have 2nd card with $1,200 credit limit. So I start to pay double annual fees' late fee' over limit fees' and all fees double ever since.

Now CapitalOne just make their plots simple and easy for the new bloods. After I started http://www.capital1card.com , they changed their TV promotion into No-Hassle Card, they pre-approve and give new bloods credit limit $200, some higher lever, they give $300. Credit limit start low stay low to enforce their evil plots easier and simpler.

I talked to my doctors about card, yes, some wealthy customer got CapitalOne card with credit limit $5,000 or over, and they don't complain about late fees or over limit fees.

I started another http://www.No-HassleCard.com , now they changed their TV promotion into No Hassle Rewards.

No Hassle Rewards ???!! Damn CapitalOne .U always have too much bloody money to change ur TV promo whenever I start another web?!)

Then everything still happened on both cards!! So I mailed $666.79 check to pay off whole thing and tried to cancel whole CapitalOne blood sucking evil cards.

Guess what?! They hided my $666.79 (cashed and never credit the amount) and charged me more LATE fees' OVER LIMIT fees and INTEREST fees and whatever. I called my bank and found out they already cashed the check month ago and still told me that my payment never received. And refused to answer anymore unless I spend $10 to buy a photo copy from my bank to prove that they did cash my payment.

Another month later I got photo copy and mailed them, they credit back $666.79 and ONLY ONE late fee with NO apology, the other late fees ' over limit fees and INTEREST fees and all the transaction f****** FEES were still there, converted'  revised, the balance was hitting sky higher after $666.79 was credit back... CapitalOne card is un-cancelable!! Debt u till death!

And one CapitalOne WISE GUY wrote me the letter saying "My supervisor want me to take special care of ur complaint, this is what I done special attention to serve you. Please let me know if u have more concerns". He must mailed out the letter with an evil grin, damn, didn't he feel great to beat up and torture another poor victim so good again.

I knew what CapitalOne  did and what CapitalOne  do!!

CapitalOne ruined my life, CapitalOne evil plots and collection harassment acts made me lost my job. YES! Now I use cash all the time because CapitalOne schedule to list my bad credit from them until year 2006! (They offered me 30% discount, then 70% discount if I would ever agree to pay anymore of their charges and fees, I rejected.) And I can not sue CapitalOne because it was over 3 years issue! I didn't learn the right way to fight until I started these web sites but it's too late for me.
And u vampires still doing the same thing to other victims. U know what u do. We got ur kind of "Good cop talk and Bad cop talk" when we try to talk to ur CUSTOMER SERVICES all the time!!

Though they charge the fee you are not entitled to make internet payment because the account is closed. Representatives want you to pay by phone for a $10.00 fee. Also, calls are often transferred to INDIA for customer service problems or inquiries. The Indians often cannot answer questions due to they are not in the USA. If you ask their location they usually reply "AN Offshore Location"

I would always find $100 worth of charges on my card for late fees and over the limit fees for payments being processed the day due but after the cutoff time for payments to be late. Not my fault that it takes them days to process payments but I was the one who paid for it. My card was constantly over the limit because I could never seem to catch up with the payments. Somehow, I was always being charged some fee that would take me over by a few dollars and then I would get charged an over limit fee. I would pay up and be told I was fine for the next two months and no payment was due only to be charged for non payment since I had a balance. My interest rate was constantly high (20%) and would not fall even though my account was in good standing. I barely used the card and yet, I paid at least $600 on a $400 credit limit for at least two years. The errors on my credit report are even worse. Every credit report says something different and yet, I don't remember being legitimately late. The customer service sucks and instead of attempting to make amends with me for such silly means to charge me for nothing I have been hung up on and treated like a vagrant trying to break into CapitalOne's house. Then one month I got my bill and its showed my last payment was late. I was charged a late fee, over limit fee, and my interest tripled. I contacted them and told them that a mistake had to of been made because I mailed my payment week in advance of its due date. I was informed that my payment was posted the following day of which the payment was due and that I had agreed to all the fees and charges. I told them it was not fair and that the most I could afford to send them was $50.00 each month. The late fee and over limit fee plus interest exceeded what I sent them and I began to fall behind. I called and told them to cancel the card and let me pay it off. They told me that fees and late charges would continue. Over the next months they called my home and employment repeatedly. I finally sent them $250.00 all at one time. The representative told me that if I would pay the $250.00 and then $177 the following month I would be below my limit and could use the card again if a desired, but the payment would go back to a low amount. I sent the $250.00  and within a week I started receiving the calls again and I told them the plan we had worked out. The had no record of any plan and the card was now restricted and could never be used again but they kept charging me late fees and over limit fees. I told them I was done and wouldn't send them another dime. They now say I owe then $1,500+ and the funning thing is the credit limit was only $300. I paid back what I actually purchased on the card with interest and the rest is their fees and charges that they kept adding. I don't understand how they can do this when their not providing me with a product or service, it has to be illegal.

Rick, remember u only allow to sue the vampire in less than 1 year or so! Sue apitalOne  NOW!! Sue the issues they did to u within 1 year or the court may not take ur case. It only cost u around $22 (depend on which city u r). It's only a SMALL claims court they always figure ur case is not worth to hire people to appear, then u win automatically. Don't try to over-sue them. $1,500 would be too much to ask. Sue them for the amount they won't want to hire a one day lawyer.

Do NOT OVER-SUE CapitalOne just because they r filthy wealthy. If u only sue them $99 or $39, the overlimit fees' the late fees they mistreated u, they won't think ur case is worth to fight. They don't appear and u win the case automatically. U get ur balance down to zero, u get ur credit fixed. But if u sue them $1,000 for whatever the damages u think really is, of course they will hire a lawyer and send ur case in. Some other town (such as Columbus GA, area code 706) get to have certain lawyer volunteer to specifically assist the CapitalOne victims. We r talking about a very fancy credit card for new bloods, with $200 credit limit' lowest interest rate they declaim but u never see it' late fees (u be late! doesn't matter when or how u pay ur payment)' overlimit fees (u be overlimit anytime they want because ur start low stay low limit is $200. Somebody was luckier, they got CapitalOne card with credit limit $300). Everybody is pre-approved, get one to see how soon ur balance can pile up to $1,000! (Yea, and ur credit limit is still $200). The membership fees r $49. Interest rate is whatever they add to get u overlimit, debt u till death.

One of them I had payment protection plan on it before I became disabled. When I was finally awarded my disability I called and sent in all the proper paper work. I never heard anything from them so I called. I was told even though I had been paying this for a case like this to happen and I was not declared disabled until year later, it would not pay my credit card off. Due to the fact that I started my paper work for disability (not declared disable a year earlier). I argued the point that I was not considered or told I was disabled until 4/02. They refused to pay off my cards and now I have to pay late fees, over the limit fees, I have asked them to take some of these fees off and they refuse. I am tired of all the calls and letters. I work so hard at getting my credit re- established now it is all gone for nothing. I live off 560.00 and 365 of it has to go to house payment. I have written cease communication forms and sent them to the company. They have lessen the calls to almost nothing now. But my credit is ruin. I feel like they should had paid off my debt as told they would in case I became disabled ( with the protection plan which apparently is another scam). I am so tired of having no credit card, no credit and no guarantee as to what they promised. I am now $12,000 in debt which they will never stop the late payments, over the limit payments, interest, Help me. I try not to answer the phone anymore hating to see if it is them on the other end.

After receiving notice that the insurance was to start in I stopped paying. Low and behold the insurance that I hade been paying on did not start up as stated, until two weeks later which in turn caused me late fees which also caused me then to have over limit fees. To make a long story short I have now hade to file for chapter 7 protection. I also have a auto loan with them ,and of course they are taking the car.

They arranged for me to make up the payment over the next 4 months. I made 3 of the payments, then before the 4th was due , I got a letter stating that I had missed a payment and they where canceling my repayment program. They then took the 3 extra payments, that they had not credited to my account and paid the property taxes, therefore now making me even further behind in my payments, and started foreclosure proceedings. I had not been late on my pay back arrangement, or how would they have been able to take the money. To stop all the actions, I had to pay CountryWide $2000.00 apx, all in there extra fees. I have complained to them about this, and since paid off my loan. When it came time to payoff, they again had a bunch of extra numbers. Every time I call, I get different answers, they now just sent a letter stating that I owe them $684.00! When they sent in their payoff demand, it included 45 days of interest, I actually paid this twice, they also charged me insurance, which I already and always had. Every time I show them that does not make sense, they just move some more numbers around. I have asked at three different times for an account history, just to get three different reports, funny how the numbers always stay the same just moved around to different columns. I have spent countless hours on the phone and letter writing, still no money back, and what about my interest on the money??? Maybe I should charge them a late fee, HA Ha Ha

First in 1997, I paid my account in full then 5 years later I get a bill saying that I didn't pay a 10 dollar fee when I closed my account and due to late fees and interest I now owed a collection agency $230.00. I then paid the money because it was just easier then trying to fight them. Now two years after that I got my credit report, because I am trying to buy a house and I find out that concern again I owe them 2 dollars and they are pilling on fees and interest. This is credit destruction on there part!!! They have intentionally not sent me a bill since 1997 and have been reporting me as LATE. They also said that I never repaid them for the $230 that I have two phone checks from. This has me so MAD that I just want to find somebody and yell at them. I want my credit history fixed and my account with them closed. Somebody Help ME!!!

You are charged with late fees and charged over the limit fees. When do these over the limit fines kick in? You pay on time and still get the over limit fees. I think most of us do not know exactly what to do. I can't get a handle on how much they have over charged me. It is just a bill that never shows you below your credit limit no matter how much you send them each month. Even over paying does not stop the never ending "fees". I would like to join in a class action suit. The idea of me taking CapitalOne  to small claims court if very intimidating.

I told them NOT to do this, I was told that I had to say it in writing, so I wrote a note and twice stapled it to my payment check. They ignored my note and made the auto debit, but Bank of America had already been told that CapitalOne  was forbidden from making ANY automatic debits, so their attempt bounced. This happened because CapitalOne  gave me the wrong address to mail my note. After numerous calls I was finally able to get them to stop making these auto debits, and was told to send my Feb and Mar. 2004 payments together. CapitalOne   received them on Mar. 15, 2004. Although my Feb payment was not due until Feb. 21, 2004, my check with note included was received on Feb. 9, 2004 (13 days earl), but because CapitalOne   told me to wait and send my Feb and Mar payments together to insure that the auto debit problem was resolved, they were both received on Mar. 13, 2004. CapitalOne  then reported to the credit companies that I was 30 days delinquent, when in fact my payment was received 23 days after it was due because they gave me the wrong address to send my request for no auto debits, so the Feb. payment was rejected. Had CapitalOne  given me the correct information, my Feb. payment would have been received 13 days early. CapitalOne  told me that they reported me as 30 days delinquent when if I had just neglected to make my Feb payment, I still would have only been 23 days late. Also I have been continuously requesting a copy of the credit card terms and conditions I originally agreed to since Jan. 21, 2004 and I have never been able to get a copy. CapitalOne  has given me almost every excuse for this, can't seem to produce the document.

Through all of this we only missed three payments over the three years. My five other creditors are working with my service. However, CapitalOne  is acting in an unbelievable manner. Three years ago I owed $500 on one card and $1000 on another card. After three years and almost $700 in payments,, I owe CapitalOne over $3 ,000, twice as much as my original balance. Is there anything that I can do to get out of this?

Then also this last fall they charged me $434 instead of $34. This led to my bank account being overdrawn and 2 nsf charges from the bank. The bank had to do a discovery to see whose fault it was and it has been over 2months and CapitalOne still has screwed up. They were at fault! They also charged a late and over limit on this to recoup their money I'm sure. Should I get a print-out from them? What should I do from here? I will be closing my account for sure.

The humrous thing is I used the card twice, yes that's it twice. once to go out for valentines dinner and the other at a store, my limit was $200.00 which I charged $198.00 and paid my min of $10 a month. to which then one month I received a bill and it was $300-$400 with all there charges. I called argued. and stopped paying them. my fianc?even talked to them and asked to speak to the manager, which the manager made a deal and would close the account and divide the total so that it would be under the limit on both accounts, one would be frozen till the first was paid off. sounded okay huh, well b/s cause all they did was add more fees to BOTH accounts and now I am receiving bills from a lawyer office, and my total is way over $1,000.00. I charged maybe $198 to that account and maybe one fee I would take claim too, but over $1000.00 ?? Pissed off customer. I have recently just said to F%^K them and eat it, but it is on my credit report.

you denied her access because she has been taken off due to bankruptcy. Only thing I can say is if you choose not to work with me, then I too will have to file bankrupt. I can not handle this. Dear Mr. Fairbank, I'm writing to alert you to a problem I've had with a credit card issued by you. My problem concerns overall experience. I hope by bringing this to your attention, the problem will be addressed. This incident has made me extremely upset. In 1997 I received in the mail a
CapitalOne credit card with a low credit limit. I was immediately charged $75.00 for the card which means I was only allowed $125.00 credit limit. I made payments on my account $50.00 per month--more than enough to pay for the principal balance as well as fees. On numerous occasions my payments were not posted timely and I was penalized with late fees as well as continuous overlimit fees. Additionally, the monthly payment requested was not sufficient to cover the fees that were charged (member fee, overlimit fee and late fee). Once I realized this, I would add the various fees to my payment. I noticed that although I made payments, the fees continued and the balance did not reduce. None of the money I paid was ever applied to the principal amount charged. Phone calls to "customer service" led to mounting frustration rather than solution. Ultimately, I paid well over 3 times the principal amount charged. I investigated further and discovered that the fees were being pyramided--which was illegal. Once I discovered the illegal practice of pyramiding fees was taking place I ceased making any further payments. When I requested the account closed, it was charged off shortly thereafter which revealed that the majority of the outstanding balance was fees and the principal balance remained untouched. It was also reported to the credit reporting agencies that the account was closed at CapitalOne 's request rather than mine. I had attempted to get an itemized payment history from them, but was refused. I have sought legal counsel regarding individual representation as well as inclusion in class action suits due to the mismanagement of my account and the illegal practice of pyramiding fees. Zero out my balance and send letters to all three credit reporting agencies, with cc's to myself, directing them to update their records accordingly to remove any negative or detrimental ratings or comments regarding this account. She called and got the balance on her account on 1-4-04, sent a check the next day for that amount. CapitalOne casheed it on 1-8-04. Then sends her a new statement on 1-12-04 for $106+ stating overlimit charges and late fees. I could not figure it out doing any math that I know and tried to talk to a supervisor after talking with one of their Cust.Svc Representatives. I transferred a balance to acquire their no interest for a year Mastercard. But if I didn't make purchases on the card monthly, they charged me interest. When I called they said I didn't read the offer correctly and could care less that I closed my account. They even charged me for transferring by balance OUT of their bank! Nasty experience.

My balance lasts month was $358 because it included a over limit charge of $29 assessed on 12/15 and a late charge of $29 even though I mailed my payment 12/1. In January, I made an online payment on the due date, but since the payment was made after 2:00 EST, it didn't get posted until 1/16 and I was charged another $29 late fee and $29 over limit fee on 1/15. On 1/16, believe it or not, I was assessed another over limit fee even though my $75 payment was received and posted. I was told that over limit fees are charged at the beginning and end of each billing cycle. How ridiculous is this??? This happened once before and I made them waive the fee, which they will not do again. I'm interested in suing these bastards. What do I need to do?

This is the worst credit card I ever had. Constant harassments and can't communicate with customer service. I can't think of any company that's worse except for household finance.

Sue the blood sucking evil  CapitalOneCard! It only cost u $22 something to drag them to the court! But if u just complain and doing nothing, they will ruin your credit report and schedule the list for the next 7 years! (Doesn't matter how much amount u disputed and they charged off!)

Richard, they are not deaf. They can read. Everyday you are mad and doing nothing, will earn them more interest fee' late fee' and over limit fee and all the hidden charges.

It only cost u around $22 dollars to sue these vampires to Small Claims Court! It's Small Claims so the maximum u can sue them is $5,000. BUT, do not over-sue them. They usually won't show up due to the cost to have people attend the court, but if u sue them more than the lawyer fee, they will pay the fees and come to fight u.

Due to an online payment not posted in time they started charging 25.00 late fees, then over the limit fees, and still continued to charge finance charges and membership fees. I wrote a letter already disputing the charges, was called a liar by a supervisor of the customer care and have been hassling with this "closed" account for over 3 years. I just received a collection letter this week for the $932.79 amount for a real balance of 124.00. How can they continue to charge me these fees when I have not even used the card for over 3 years? I don't know what to do, I live in Peru, In, can you help me?

To my surprise the customer service rep. cancelled my card! CapitalOne refused to reopen the card for months and they still haven't. Finally at the end of last year someone called me and asked if I wanted to speak to supervisor. I had already allegedly spoken to three supervisors. Isn't this fraud!

As soon as I would Receive my bill I would send payments within a couple of days of receiving the statement. But this didn't stop The account from "supposedly" being paid late a couple of times. It seems that at times CapitalOne would hold my payment so It could be posted late. At times they would not deposit my checks for weeks. Anyways, I called them, complained about it, they would issue me a credit. The catch is that even though they'll issue you the credit, they won't fix the apr. That little finance charges Or the Apr on the bottom Right corner of your bill. One Day I saw the APR had Sky rocketed to over 20.62% Without any notification whatsoever. I Called them to cancel the card. I got the statement with: "your request to close your account has been received. Your account will be closed when it reaches a zero balance. until then, you will continue to receive statements and must continue to make payments. All terms and conditions of the account will apply while a balance remains. Please remember to cut your cards and cancel all Charges which automatically bill to your account." Yeah. Typed  Neatly below the fees that they charged. Which basically means that while your owe them, they still will throw in the fees they want. Yeah They will own you. And you will continue to accrue all late fees and such. I was automatically charged $25.00 Past Due Fee Just for canceling the card. Without Being Late. Let me inform you that my charges for the prior month was below my overlimit fee of $200.00 plus I had paid the minimum on time and it was reflected on my statement. Now Check this out. When I canceled the card they charged a $25.00 past due Fee plus $1.00 for an account balance coverage premium and an 800 number posted on the statement. Needles to say I paid the entire balance on on February. Let me tell you that all this occurred in 2000 and I just fount out in 2003 that they Had polluted my credit Report With a 90...

Nelson, Sue the vampires NOW!! U only allowed to sue them on certain time period, but the bad report they did to u (doesn't matter how much amount you disputed and they charged off) will stay over 7 years if u just complain and don't take action to fight back in time!!

Here is what they did to me. I told them of a problem with the 2 CapitalOneCards I had in which I always pay my bills for online. At one point in August I switched banks and updated the bank information in the system. In December, my old bank called and told me I currently have $170 dollars in fees to pay for attempted withdrawals while I had insufficient funds. After going to the bank I found CapitalOne was still trying to access this account for the payments, then once the bank declined them, they would go to the correct bank account for payments. This was done at least four times. I contacted their customer service and told them of what was happening and they told me that it was my fault because I didn't update the bank information correctly nor did I confirm it afterwards. They told me this in response no matter how many time I explained this. Finally I lost my cool with the representative and told him to logically think about this, if my information wasn't correctly updated, how were they accessing the correct bank right after the other bank declined them. And all they told me is that they weren't responsible for fees charged to me from my bank. CapitalOne has had horrible service from very early into my accounts with them, I can relate to almost all the complaints posted so far, from the unauthorized account charges, to the ridiculous payments they wanted for being kicked over my limit by these unauthorized charges, all the way to them giving my information to every telemarketer company out there. As of right now I will be taking them to small claims court pending the final letter I sent them.

A week later I was notified that this account was transferred to a Collection agency. It is now $2,004, and I have sent over 20 letters of correspondence to each collection agency who has owned this debt to contest it, however, I either do not receive any response, or this debt is sold to yet another collection agency. I do not feel I should be held responsible for a debt that I did not incur. The debt is now at a total of $2,398.17. Any suggestions on how to eliminate this debt?

According to CapitalOne, in March 2002, someone reported my card stolen and ordered a brand new card to be UPSed to my house. They then proceeded to withdraw a thousand dollars cash advance from my card soon after. I didn't even know about this activity till CapitalOne sent me a notice in December 2002 stating that I owed them $1,000 plus interest which came out to around $1, 200. I disputed the charges, but CapitalOne told me that since they had UPS'd it to my house and someone had signed for it, it was fraud from within my household, and thus they're not responsible for the fraudulent charges. I told them I hadn't received a statement till 8 months after the fraudulent activity had taken place, and that I had never reported my card stolen nor had any kind of contact with CapitalOne for almost 2 years. Their reply was that I should have called them earlier and to basically tell me that the fraudulent activity had occurred in my own household. I went to the police to file a report but they wouldn't do anything without a statement of that billing cycle for them to investigate. CapitalOne, however gave me the runaround for 4 months when I tried to obtain the statement of 3/02-4/02. Without that statement, the police wouldn't help me, and without the police helping me, CapitalOne proceeded to file an affidavit against me to sue me for the money. I thought that we as consumers had some sort of protection against Credit Card fraud. Can someone give me some advice? The amount they're suing for is too small for me to bother hiring an attorney. What do you guys think? - Confused in NY

P.S. UPS has told me they have no record of any deliveries of that sort to my house during the entire year of 2002.
CapitalOne and their associates seem to be trying to get me to settle before going to court because as they said "if they find it was someone in your house, you're liable for the money and criminal punishment too." Please help!

THAT WAY THEY CAN'T SAY THEY DIDN'T RECEIVE PAYMENT ON TIME. IT COSTS A LITTLE MORE BUT LESS THAN A "LATE FEE" ANOTHER TRICK THEY USE IS TO ADD THE "MEMBERSHIP FEE" TO TRY TO GET YOU OVER THE CREDIT LIMIT.
Where is the Law when you really really need it ?!
